Extradition (Designated Foreign Countries)

(Amendment) Order, 2021

IN EXERCISE of the powers conferred by article 7 of the

Extradition Act, the Minister for Justice, Equality and Governance, has

made the following order:-

The title of this order is the Extradition (Designated

Foreign Countries) (Amendment) Order, 2021 and this order shall be

read and construed as one with the Extradition (Designated Foreign

Countries) Order, hereinafter referred to as "the principal order".

In article 2 of the principal order, immediately after the

definition "Schengen Information System" there shall be added the

following new definition

" "Trade and Cooperation Agreement" means the Trade and

Cooperation Agreement signed on 30 December 2020 between

the European Union and the European Atomic Energy

Community and the United Kingdom of Great Britain and

Northern Ireland;".

Article 5A of the principal order shall be amended as

follows

(a) in sub-article (1) thereof, immediately after the words

"as contained in the Annex to the Arrangement" there shall be

added the words "or as contained in ANNEX LAW-5 to the

Trade and Cooperation Agreement, as the case may be"; and

(b) in sub-regulation (2) thereof, immediately after the

words "as contained in the Annex to the Arrangement" there

shall be added the words "or as contained in ANNEX LAW-5 to

the Trade and Cooperation Agreement, as the case may be".

In sub-article (8) of article 62 of the principal order,

immediately after the words "contained in the Annex to the

Arrangement" there shall be added the words "or as contained in

ANNEX LAW-5 to the Trade and Cooperation Agreement, as the case

may be".
