Identity Malta Agency

(Establishment) (Amendment) Order, 2020

IN EXERCISE of the powers conferred by article 26 of the

Public Administration Act, the Prime Minister has made the following

The title of this order is the Identity Malta Agency

(Establishment) (Amendment) Order, 2020 and this order shall be read

and construed as one with the Identity Malta Agency (Establishment)

Order, hereinafter referred to as the "principal order".

The definition of "Minister" shall be substituted by the

following new definition

" "Minister" means the Minister responsible for identity

management who shall be responsible for the Agency;".

Article 3 of the principal order shall be amended as

(a)

sub-article (1) thereof shall be amended as follows

(i) in paragraph (a) thereof, the word "citizenship"

shall be deleted;

(ii) paragraph (c) thereof shall be substituted by the

following new paragraph

"(c) processing of applications for national visas

under the Immigration Act by assisting the Principal

Immigration Officer in the execution of his duties and

functions related to such matters and in the

implementation of any European Union legal instrument

related to visas by giving also its assistance in such

matters;";

(iii) paragraph (g) thereof shall be deleted;

(iv) paragraph (h) thereof shall be renumbered as

paragraph (g); and

(v)

the proviso thereof shall be deleted;

(b)

sub-article (2) thereof shall be amended as follows

(i)

paragraphs (a) and (e) thereof shall be deleted;

(ii) paragraphs (b), (c) and (d) thereof shall be

renumbered as paragraphs (a), (b) and (c) respectively;

(iii) paragraph (a) as renumbered

shall

be

substituted by the following new paragraph

"(a) see the carrying out of the functions and

duties of the "authorised officer" designated under the

Identity Card and other Identity Documents Act;"; and

(iv) immediately after paragraph (c) as renumbered

there shall be added the following new paragraphs

"(d) see to the carrying out of the functions

and duties of the Director for Citizenship and

Expatriate Affairs provided for under the

Immigration Act and subsidiary legislation made

thereunder, and;

(e) see to the carrying out of the functions

and duties related to the issue of visas in line with

the provisions of paragraph (c) of sub-article 3(1);";

and

(c) immediately thereafter there shall be added the

following new sub-article

"(3) Where any functions referred to in the

preceding sub-article, is entrusted to a public officer in

terms of any other law, such function shall be exercised by

that public employee of the Agency assigned to carry out

the said function.".

Article 4 of the principal order shall be deleted.

Article 9 of the principal order shall be renumbered as Amends article

article 8 and immediately after sub-article (3) thereof, there shall be 9 principal

"(4) The Chief Executive Officer may exercise those

powers, function and duties exercised by any officer under his

responsibility unless such powers, functions and duties are, in

terms of law, vested exclusively in the said officer.".

Article 10 of the principal order shall be renumbered as

article 9 respectively.
