Fishing Vessels (Amendment No. 2) Regulations, 2020
IN EXERCISE of the powers conferred by article 38 of the
Fisheries Conservation and Management Act, the Minister for
Agriculture, Fisheries and Animal Rights, has made the following
regulations:-
The title of these regulations is the Fishing Vessels Citation.
(Amendment No. 2) Regulations, 2020 and these regulations shall be
read and construed as one with the Fishing Vessels Regulations, S.L. 425.07.
hereinafter referred to as the "principal regulations".
(1) Immediately after regulation 23 of the principal Add new
regulations, there shall be added the following new regulation
(1) Without prejudice to sub-regulation (2),
all effects at law of the provisions of regulation 9,
inclusive of any terms therein provided, shall be
suspended throughout the year 2020
Provided that the Director may, by order in
the Gazette, extend the period of suspension due to
extraordinary circumstances affecting the fishing
industry.
(2) Notwithstanding the provisions of sub-
regulation (1), the following rights shall retain effect
throughout the year 2020 and throughout any period of
extension as provided according to the proviso of sub-
regulation (1)
(a) the right to be removed from the
temporary register referred in regulation 9 upon a
vessel totally restarting its commercial fishing
activity according to Schedule III; and
(b) the right to regain a right of registration
in categories A or B, as applicable for a particular
vessel and as lost in accordance with regulation 9,
upon payment of the amount provided in regulation
9 and upon that vessel totally restarting its
commercial fishing activity according to Schedule
III.
(3) Upon termination of the periods provided
according to sub-regulation (1), all terms provided under
regulation 9 shall continue to run and all the effects of
regulation 9 shall be applicable at law.".
