(CAP. 12)

Code of Organization and Civil Procedure (Amendment of

Schedule A) Regulations, 2020

IN EXERCISE of the powers conferred by article 1004 of the

Code of Organization and Civil Procedure, the Minister responsible

for justice, with the concurrence of the Minister responsible for

finance, has made the following regulations:-

The title of these regulations is the Code of Organization Citation.

and Civil Procedure (Amendment of Schedule A) Regulations, 2020,

and these regulations shall be read and construed as one with Schedule

A to the Code of Organization and Civil Procedure, hereinafter Cap. 12.

referred to as "the Code".

In item 8 of Tariff A of Schedule A to the Code, Amends Tariff

immediately after the words "€35" there shall be added the following A

to the Code.

new proviso

"Provided that when the Superintendent of Public

Health orders the closure of the court in terms of the Public

Health Act, the fees established in this item shall not apply to

actions mentioned in items 1 (a) and (c) of this Tariff; with the

exception of actions relating to the civil status of a person,

relating to human rights or relating to general elections and of

actions of possession and jactitation suits or concerning personal

injury, claims for the payment of wages or claims for unjust

dismissal from employment; in the event that the opening of the

registry is requested on any working day during the opening

hours established by law.".

In item 12 of Tariff B of Schedule A to the Code, Amends Tariff

immediately after the words "€ 35" there shall be added the following B to of the Schedule

new proviso

"Provided that when the Superintendent of Public

Health orders the closure of the court in terms of the Public

Health Act, the fees established in this item shall not apply to

actions mentioned in items 16 (a) and (c) of this Tariff; with the

exception of actions relating to the civil status of a person,

relating to human rights or relating to general elections and of

actions of possession and jactitation suits or concerning personal

injury, claims for the payment of wages or claims for unjust

dismissal from employment; in the event that the opening of the

registry is requested on any working day during the opening

hours established by law.".

In item 6 of Tariff D of Schedule A to the Code,

immediately after the words "€ 35" there shall be added the following

new proviso
