Energy Efficiency and Cogeneration

(Amendment) Regulations, 2019

IN EXERCISE of the powers conferred by article 37 of the

Regulator for Energy and Water Services Act and article 6 of the

Building Regulation Act, the Minister for Energy and Water

Management and the Minister for Transport, Infrastructure and Capital

Projects, after consultation with the Building Regulation Board, the

Regulator for Energy and Water Services and the Planning Authority,

have made the following regulations:-

(1) The title of these regulations is the Energy Efficiency Citation.

and Cogeneration (Amendment) Regulations, 2019 and these

regulations shall be read and construed as one with the Energy

Efficiency and Cogeneration Regulations, hereinafter referred to as S.L. 545.16.

(2) These regulations transpose point (5)(a) of Article 70 of

Directive (EU) 2019/944 of the European Parliament and of the

Council of 5 June 2019 on common rules for the internal market for

electricity and amending Directive 2012/27/EU.

(a) sub-regulation (5) thereof shall be substituted by the

following new sub-regulation

"(5) Transmission system operators and distribution

system operators shall comply with the requirements set

out in the Eleventh Schedule. The transmission system

operator and the distribution system operator shall facilitate

the connection to the grid system of electricity produced

from high-efficiency cogeneration from small scale and

micro cogeneration units. The Regulator shall, where

appropriate, take steps to encourage network operators to

adopt a simple notification "install and inform" process for

the installation of micro cogeneration units to simplify and

shorten authorisation procedures for individual citizens and

installers.";

(b)

sub-regulation (6) thereof shall be deleted; and

(c) sub-regulation (7) to sub-regulation (11) thereof shall be

renumbered as sub-regulation (6) to sub-regulation (10) respectively.

In the Eleventh Schedule to the principal regulations the

words "Regulation 17(6)" shall be substituted by the words

"Regulation 17(5)".
