Development Planning (Fees)

(Amendment) Regulations, 2019

BY VIRTUE of the powers conferred by articles 81(4), and

85(2)(a) of the Development Planning Act, the Parliamentary

Secretary for Planning and the Property Market, after consultation

with the Planning Authority, has made the following regulations:-

Reg. 1 Citation. — 21 tal-2019 – Regolamenti tal-2019 li jemendaw ir-Regolamenti dwar Ħlasijiet tal-Ippjanar tal-Iżvilupp Open official source

The title of these regulations is the Development Planning

(Fees) (Amendment) Regulations, 2019, and these regulations shall be

read and construed as one with the Development Planning (Fees)

Regulations, hereinafter referred to as "the principal regulations".

Reg. 2 Amends Schedule 1 to the principal regulations. — 21 tal-2019 – Regolamenti tal-2019 li jemendaw ir-Regolamenti dwar Ħlasijiet tal-Ippjanar tal-Iżvilupp Open official source

Schedule 1 of the principal regulations shall be amended as

follows

(a) in the table entitled ''Category D'' thereof,

immediately after the sixth row thereof there shall be added the

words ''Requests for Revocation or Modification of Permission'',

and in the second column thereof, there shall be added the figure

''€500'';

(b) paragraph 11 thereof shall be renumbered as

paragraph 11(1) and immediately thereafter there shall be added

the following new paragraph

''11. (2) The fee paid in relation to a request for

revocation or modification of a permission issued by the

Authority shall be refunded if it is established that the

request was justified.''.
