Passenger Transport Services (Amendment No 2) Regulations, 2019

IN EXERCISE of the powers conferred by article 43 of the

Authority for Transport in Malta Act, the Minister for Transport,

Infrastructure and Capital Projects, after consultation with the

Authority for Transport in Malta, has made the following regulations:-

The title of these regulations is the Passenger Transport Citation.

Services (Amendment No 2) Regulations, 2019, and these regulations

shall be read and construed as one with the Passenger Transport S.L. 499.56.

Services Regulations, hereinafter referred to as "the principal

regulations".

Regulation 9 of the principal regulations shall be amended Amends

(a)

in sub-regulation (1) thereof

(i) sub-paragraphs (iii) and (iv) of paragraph (a)

shall be renumbered as sub-paragraphs (iv) and (v) and

immediately after sub-paragraph (ii) there shall be added

the following new sub-paragraph

''(iii) articles 40A, 40B, 120A and 120B of the

Medical and Kindred Professions Ordinance.'';

(ii) immediately after paragraph (c), before the

proviso thereto, there shall be added the following new

paragraph

''(d) if he has been found guilty of committing

any corresponding offence under any law of a country

or territory outside Malta:''; and

(b) in sub-regulation (2) thereof, immediately after

paragraph (d), there shall be added the following new paragraph

''(e) sentence for the commission of an offence of

possession for exclusive personal use mentioned in sub-

paragraphs (iii) and (iv) of sub-regulation (1)(a), which

sentence was delivered at least three years before the date

of new application or renewal of tag, where the applicant

has rehabilitated oneself by means of a rehabilitation

program and applicant shall have no other sentence in these

three years.''.
