Motor Vehicles (Amendment No. 2) Regulations, 2019

IN EXERCISE of the powers conferred by article 54 of the

Traffic Regulation Ordinance and by article 43 of the Authority for

Transport in Malta Act, the Minister for Transport, Infrastructure and

Capital Projects, after consultation with the Authority for Transport in

Malta, has made the following regulations:-

The title of these regulations is the Motor Vehicles Citation.

(Amendment No. 2) Regulations, 2019 and they shall be read and

construed as one with the Motor Vehicles Regulations, hereinafter S.L. 65.11.

referred to as "the principal regulations".

Regulation 62D of the principal regulations shall be Amends

regulation 62D

amended as follows

of the principal

regulations.

(a) in sub-regulation (1)(a) thereof, sub-paragraphs (iii)

and (iv) shall be renumbered as sub-paragraphs (iv) and (v) and

immediately after sub-paragraph (ii) there shall be added the

following new sub-paragraph

''(iii) articles 40A, 40B, 120A and 120B of the

Medical and Kindred Professions Ordinance.''; and

(b) in sub-regulation (2) thereof, immediately after

paragraph (c), there shall be added the following new

paragraphs

''(d) sentence for the commission of an offence

which -

(i)

was committed before the 13th April

2018;

(ii) was committed by a person who had a

valid driver’s tag issued to him by the Authority

before the 13th April 2018; and

(iii) was delivered at least five years before

the date of application for the renewal of the driver’s

tag and of the driver’s permit;

(e) sentence for the commission of an offence of

possession for exclusive personal use mentioned in sub-

paragraphs (iii) and (iv) of sub-regulation (1)(a) above,

which sentence was delivered at least three years before the

date of new application or renewal of tag, where the

applicant has rehabilitated oneself by means of a

rehabilitation program and applicant shall have no other

sentence in these three years.''.
