(CAP. 35)

Fees leviable by Government Departments (Amendment No. 3)

Regulations, 2018

IN EXERCISE of the powers conferred by article 2 of the Fees

Ordinance, the Minister for Transport, Infrastructure and Capital

Projects, with the concurrence of the Minister responsible for

Finance, has made the following regulations:-

The title of these regulations is the Fees leviable by

Government Departments (Amendment No. 3) Regulations, 2018,

and they shall be read and construed as one with the Fees leviable by

Government Departments Regulations, hereinafter referred to as "the

principal regulations".

The Schedule to the principal regulations, under the

heading "Ministry for Transport and Communications", in the section

"Radiocommunications", in part "II. Licence for:", shall be amended

as follows

(a) item 3 thereof, shall be substituted by the

following

"3. (a)

Fixed radio link operating in frequency bands

below 1 GHz, for each terminal, depending upon the bandwidth, per

annum fee

(i)

not more than 100 kHz ..................................................

(ii)

more than 100 kHz up to 1 MHz ...................................

(iii)

more than 1 MHz up to 10 MHz ....................................

(iv)

more than 10 MHz up to 100 MHz ................................

(b) paragraphs (b), (c), (d) and (e) in item 4 thereof, shall be

deleted;

(c) immediately after paragraph (a) of item 4 thereof, there

shall be added the following

(f) item 26 thereof, shall be substituted by the following

operating in accordance with the Eighth Schedule of the General

(g) item 27 thereof, shall be substituted by the following

"27. Low duty cycle /high reliability devices operating in

accordance with the Seventh Schedule of the General Authorisations

(h) item 44 thereof, shall be substituted by the following

"44. Earth Stations on Mobile Platforms operating with

49. Exemptions from any fees applicable under this Part

No fees shall be levied under this Part in relation to the

installation or use of any radio communications apparatus however

so described by a foreign dignitary for the duration of the stay of any

such dignitary in Malta

Provided that for the purposes of this Part "a foreign

dignitary" means any person present in Malta and who is a dignitary

or a high official of a State other than Malta or of an international

organisation recognised by the Minister responsible for foreign

affairs

Provided further that the duration of any such stay does not

exceed thirty consecutive days . ";

(j) in the English text thereof, for the words "II. Duplicate

copy of licence:" there shall be inserted the words "III. Duplicate

copy of licence"; and

(k) all the section "Radiocommunications", under the heading

"Ministry for Transport and Communications" as amended above,

shall in its entirety, be deleted and inserted immediately after the

section "Oil exploration", under the heading "Office of the Prime

Minister".
