Commencement Notice

IN EXERCISE of the powers conferred by sub-articles (2) and

(3) of article 1 of the Code of Organization and Civil Procedure

(Amendment) Act, 2018 the Minister for Justice, Culture and Local

Government

(1) has established the 11th June 2018 as the date when

the following provisions of article 3 of the said Act shall come

into force

(a) sub-article (a) of article 3 which amends article

41 of the Code of Organization and Civil Procedure to re-

number sub-articles (2) to (7) thereof as sub-articles (5) to

(10) and to substitute sub-article (1) thereof with the new

sub-articles (1), (2), (3) and (4);

(b) sub-article (b) of article 3 which substitutes

sub-article (8) of article 41 of the Code of Organization and

Civil Procedure as re-numbered only insofar as this refers

to appeals from judgements of the Civil Court, First Hall,

of the Civil Court (Family Section) and of the Civil Court

(Commercial Section), sohowever that the said sub-article

(8) as renumbered and as worded prior to the coming into

force of the amendment brought into force by the present

commencement notice shall remain in force only insofar as

it confers jurisdiction on the Court of Appeal to hear and

determine appeals from the Court of Magistrates (Gozo) in

its superior jurisdiction;

(2) hereby provides as a transitory provision that any

reference in any law enacted prior to this commencement notice

to the Court of Appeal as constituted in terms of sub-article (6)

of article 41 of the Code of Organization and Civil Procedure

shall, until that reference is amended, be construed as a reference

to the Court of Appeal as constituted in terms of sub-article (9)

of article 41 of the Code of Organization and Civil Procedure as

re-numbered by virtue of this commencement notice.
