PRODUCT SAFETY ACT

(CAP. 427)

Personal Protective Equipment Regulations, 2018

IN exercise of the powers conferred by articles 39 of the Product

Safety Act, the Minister Justice, Culture and Local Government, on

the advice of the Malta Competition and Consumer Affairs Authority,

has made the following regulations:-

(1) The title of these regulations is the Personal Title and

commencement.

Protective Equipment Regulations, 2018.

These regulations shall come into force on the 21st April

2018.

(1) These regulations implement the requirements set by Implementation

Regulation (EU) 2016/425 of the European Parliament and of the provision.

Council of 9 March 2016 on personal protective equipment and

repealing Council Directive 89/686/EEC.

(2) The procedures for the assessment and notification of

conformity assessment bodies, and the monitoring of notified bodies

shall be those prescribed in the Method for Designating Conformity

Assessment Bodies Regulations.

(3) With respect to Articles 8(6), 8(7), 8(10), 10(3), 10(4),

10(9), 11(2), 15(2) of Regulation (EU) 2016/426, the language used

shall be Maltese or English.

The Technical Regulations Division within the Malta Designation of

Competition and Consumer Affairs Authority is the notifying authority notifying

authority.

within the meaning of Article 21 of Regulation (EU) 2016/425.

The penalties applicable to any infringement related to Penalties.

Regulation (EU) 2016/425 shall be those provided for in Part IV of the Cap. 427.
