FINANCIAL ADMINISTRATION AND AUDIT ACT
(CAP. 174)
Public Procurement (Amendment) Regulations, 2018
BY VIRTUE of the powers conferred by article 4 of the Financial
Administration and Audit Act, the Minister for Finance has made the
following regulations: -
The title of these regulations is the Public Procurement Citation.
(Amendment) Regulations, 2018, and these regulations shall be read
and construed as one with the Public Procurement Regulations, S.L. 174.04
hereinafter referred to as the "principal regulations".
Regulation 97 of the principal regulations shall be Amends
renumbered as regulation 97(2) and immediately before sub-regulation regulation
(2) as renumbered there shall be added the following new sub- regulations.
regulation (1)
"(1) The judicial acts, written pleadings and other
documents which are to be filed with the Secretary of the
Commercial Sanctions Tribunal may be filed in the Registry of
the Civil Courts and Tribunals, Malta.".
In regulation 209 of the principal regulations sub- Amends
regulations (3) and (4) thereof shall be renumbered as sub-regulations regulation
(4) and (5) respectively and immediately after sub-regulation (2) regulations.
thereof there shall be added the following new sub-regulation
"(3) If the registered letter or judicial letter
mentioned in sub-regulation (2) is not notified to the
defendant, it shall be the responsibility of the Director of
Employment and Industrial Relations to cause a copy of
the application and all the documents attached with the
application to be served on the defendant, and such
service shall be effected through the mode of service
established in article 187 of the Code of Organization and
Civil Procedure.
The fees mentioned in paragraph 6 of Tariff A of
Schedule A of the Code of Organization and Civil
Procedure shall apply to such service.".
Sub-regulation (1) of regulation 210 of the principal
regulations shall be substituted by the following
"(1) The Secretary of the Commercial Sanctions Tribunal
shall notify the Director of Employment and Industrial Relations
and the defendant of the date on which the first hearing will be
held. The notice of hearing shall be communicated by the
Secretary to the defendant together with the application and
documents mentioned in sub-regulation (2) of regulation 209.".
