Registration and Licensing of Motor Vehicles (Amendment)

Regulations, 2018

IN EXERCISE of the powers conferred by article 20 of the

Motor Vehicles Registration and Licensing Act, and by article 43 of

the Authority for Transport in Malta Act, the Minister responsible for

Transport, Infrastructure and Capital Projects, with the concurrence of

the Minister responsible for finance and after consultation with the

Authority for Transport in Malta, has made the following regulations

The title of these regulations is the Registration and Title.

Licensing of Motor Vehicles (Amendment) Regulations, 2018 and

these regulations shall be read and construed as one with the

Registration and Licensing of Motor Vehicles Regulations, hereinafter S.L.368.02.

referred to as "the principal regulations".

Paragraph (g) of sub-regulation (1) of regulation 4 of the Amends

regulation 4 of

principal regulations shall be substituted by the following

"(g) a legally valid identification document issued in Cap. 258.

terms of the Identity Card and other Identity Documents Act, or

some other legally valid identification document or a residence Cap. 217.

permit document issued in terms of the Immigration Act:";

Regulation 6 of the principal regulations shall be amended Amends

in sub-regulation (4) thereof

(a) in paragraph (h), for the words "Certificate of

Authenticity issued by a body accredited by the Authority

and", there shall be substituted the words "documentation

approved by the Authority";

(b)

in paragraph (i)

(i) for the words "Certificate of Authenticity

issued by a body approved by the Authority", there

shall be substituted the words "documentation

approved by the Authority";

(ii) the first proviso shall be substituted by the

following new proviso

"Provided that where a Certificate of

Authenticity is not provided, the Authority may

always request any additional documentation besides

the documentation submitted by the applicant and

may also carry out any checks and verifications in

order to confirm the authenticity of the odometer

reading:".

(c) paragraph (j) shall be substituted by the

following

"(j) a legally valid identification document

issued in terms of the Identity Card and other Identity

Documents Act, or some other legally valid

identification document or a residence permit

document issued in terms of the Immigration Act;".

(2)

in sub-regulation (6) thereof

(a) paragraphs (b) and (c) shall be renumbered as

paragraphs (c) and (d) and immediately after paragraph (a),

there shall be added the following new paragraph

"(b) the payment by the owner, importer or

authorised dealer of any fines incurred by the motor

vehicle in question in Malta;".

Sub-regulation (1) of regulation 31 of the principal

regulations shall be amended as follows

(a) in paragraph (i) for the words "the letters BY" there

shall be substituted the words "the letters BUS";

(b) in paragraph (xii) for the word "trains." there shall be

substituted the word "trains;"; and

(c) immediately after paragraph (xii) there shall be added

the following new paragraphs

"(xiii)

the letters TEY in respect of electric

trolley vehicles;

(xiv) the letters MHY in respect of Malta heritage

buses; and

(xv) the letters CSH in respect of car sharing

vehicles.".

Regulation 39 of the principal regulations shall be amended Amends

regulation 39 of

as follows

the principal

regulations.

(1)

in sub-regulation (1) thereof

(a) in the first proviso, for the words "1st March,

2016" there shall be substituted the words "30th June,

2019";

(b) in the second proviso, for the words "2nd

March, 2016" there shall be substituted the words "1st

October, 2020" and for the words "one hundred euro

(€100)" there shall be substituted the words "one hundred

and fifty euro (€150)";

(c) in the third proviso, for the words "five hundred

euro (€500)" there shall be substituted the words "six

hundred euro (€600)" and for the words "2nd March, 2016"

there shall be substituted the words "16th October, 2020";

(2) immediately after sub-regulation (2) thereof, there

shall be added the following new sub-regulation

"(3) An end-of-life motor vehicle and any other

motor vehicle which has been scrapped or de-registered in

accordance with these regulations after the 1st November,

2013 shall not be re-registered with the Authority

Provided that an end-of-life motor vehicle and any

other motor vehicle which has been scrapped or de-

registered in accordance with these regulations prior to the

1st November, 2013, may be registered anew with the

Authority upon payment of the applicable registration tax

and any other sums which may be due to the Authority.".

In the First Schedule to the principal regulations, under the Amends the

heading ‘Description’ relative to the Type ‘Standard Alphanumeric First

of the principal

Format (Random)’, for the word "black" there shall be substituted the regulations.

word "green" and for the word "green" there shall be substituted the

word "silver".

The Second Schedule to the principal regulations shall be

amended as follows

(a) in the paragraph which starts with the words "The

registration mark shall be formed of black characters",

immediately after the words "registration mark" there shall be

added the words ", with the exception of vintage vehicles and

vehicles registered in terms of article 8(4) of the Act,";

(b) the paragraph which reads "The plate on which the

registration mark of a vintage vehicle is exhibited shall carry

green characters.", shall be substituted by the following

"The plate on which the registration mark of a vintage

vehicle is exhibited shall carry silver characters on a black

background."; and

(c) the last paragraph shall be substituted by the

following

"The plates for vintage vehicles and vehicles

registered in terms of article 8(4) of the Act shall, with the

exception of the colour of the characters, the periphery of

the plate and, in the case of vintage vehicles, the colour of

the plate, have the same dimensions and composition of all

other registration plates as defined in this Schedule.".
