AUTHORITY FOR TRANSPORT IN MALTA ACT

Taxi Services (Amendment) Regulations, 2018

IN exercise of the powers conferred by article 43 of the

Authority for Transport in Malta Act, the Minister for Transport and

Infrastructure, after consultation with the Authority for Transport in

Malta, made the following regulations

The title of these regulations is the Taxi Services Title.

(Amendment) Regulations, 2018 and they shall be read and construed

as one with the Taxi Services Regulations, hereinafter referred to as S.L. 499.59.

"the principal regulations".

In sub-regulation (3) of regulation 11 of the principal Amends

regulations, immediately after the words "conviction against him" regulation

the principal

there shall be added the words "of any offence contemplated in regulations.

paragraph (a) of sub-regulation (1) of regulation 11A".

Sub-regulation (1) of regulation 11A of the principal

regulations shall be amended as follows

(a)

paragraph (a) thereof shall be substituted by the following

"(a) if he has been found guilty of committing any crime

contemplated in

(i) Title I of Part II of Book First of the Criminal

Code or articles 198, 199, 203, 203A, 204, 204A, 204B,

204C, 205, 211, 212, 217 (in the event that the arms proper

used for the commission of the offence is a fire-arm), 220,

238(a), 248B, 248C, 248D of the Criminal Code;

(ii) articles 2, 3, 5, 7, 8, 9 and 10 of the White

Slave Traffic (Suppression) Ordinance;

(iii) articles 4, 5, 6(a), 7, 8(b), 8(c), 15, 15A, 16,

18 and 22 of the Dangerous Drugs Ordinance; and

(iv) articles 37, 38, 44, 50 and 61 of the Malta

Armed Forces Act;";

(b) sub-paragraphs (i), (ii) and (iii) of paragraph (c) thereof

shall be substituted by the following

"(i) of three months for sentences of imprisonment for a

term of at least six months and not more than two years; and

(ii) equal to one-fourth of the term of imprisonment for

which such person was sentenced for sentences for terms of

imprisonment of more than two years;";

(c) paragraphs (d), (e) and (f) thereof shall be deleted and

paragraph (g) thereof shall be renumbered as paragraph (d) thereof;

(d) the first proviso to paragraph (d) as renumbered thereof

shall be deleted and for the second proviso thereof there shall be

substituted the following

"Provided that where the applicant was less than eighteen

years of age at the time of the commission of the offence, the

period referred to in paragraph (c) shall not be longer than two

years.".

Amends regulation 11A of the principal regulations.

Regulation 14 of the principal regulations shall be

amended as follows

(a)

in sub-regulation (3) thereof, the words "regulation

11:" shall be substituted by the words "regulation 11A." and the

proviso thereto shall be deleted; and

(b) in sub-regulation (7) thereof, the words "sub-

regulations (2) and (3)" shall be substituted by the words "sub-

regulation (2)".
