AUTHORITY FOR TRANSPORT IN MALTA ACT

(CAP. 499)

Passenger Transport Services (Amendment No. 2)

Regulations, 2017

IN exercise of the powers conferred by article 43 of the

Authority for Transport in Malta Act, the Minister for Transport has,

after consultation with the Authority for Transport in Malta, made the

following regulations:-

The title of these regulations is the Passenger Transport

Services (Amendment No. 2) Regulations, 2017, and these

regulations shall be read and construed as one with the Passenger

Transport Services Regulations, hereinafter referred to as "the

principal regulations".

Regulation 9 of the principal regulations shall be amended

as follows

(a) paragraph (a) of sub-regulation (1) thereof shall be

substituted by the following

"(a) if he has been found guilty of

committing any crime contemplated in -

(i)

Title I of Part II of Book First

of the Criminal Code or articles 198, 199,

203, 203A, 204, 204A, 204B, 204C, 205,

211, 212, 217 (in the event that a fire-arm

was used for the commission of the

offence), 220, 238(a), 248B, 248C, 248D

of the Criminal Code;

(ii) articles 2, 3, 5, 7, 8, 9 and 10 of

the White Slave Traffic (Suppression)

Ordinance;

(iii) articles 4, 5, 6(a), 7, 8(b), 8(c),

15, 15A, 16, 18 and 22 of the Dangerous

Drugs Ordinance; and

(iv) articles 37, 38, 44, 50 and 61 of

the Malta Armed Forces Act;";

(b) sub-paragraphs (i), (ii) and (iii) of paragraph (c) of

sub-regulation (1) thereof shall be substituted by the following

"(i) of three months for sentences of

imprisonment for a term of at least six months and not

more than two years;

(ii) equal to one-fourth of the term of

imprisonment for which such person was sentenced for

sentences for terms of imprisonment of more than two

years";

(c)

paragraphs (d), (e), (f) and (g) of sub-regulation (1)

thereof shall be deleted;

(d) the first proviso to paragraph (h) of sub-regulation

(1) thereof shall be deleted;

(e)

in the second proviso to paragraph (h) of sub-

regulation (1) thereof, for the words "in paragraphs (c), (d) and

(e)" there shall be substituted the words "in paragraph (c)"; and

(f)

in sub-regulation (3) thereof, for the words

"conviction against him" there shall be substituted the words

"conviction against him for any offence contemplated in sub-

regulation (1)(a)".

The first proviso to sub-regulation (3) of regulation 14 of Amends

regulation 14 of

Regulation 19 of the principal regulations shall be Amends

regulation 9(1)(a)".

Regulation 28 of the principal regulations shall be Amends

(a)

the second proviso to sub-regulation (1) thereof

shall be substituted by the following

"Provided further that paragraphs (b) and (c) shall

not apply to Malta heritage buses."; and

(b) the third proviso to sub-regulation (2) thereof shall

be substituted by the following

"Provided further that, with regard to Malta

heritage buses, paragraphs (b) and (c) of sub-regulation (1)

and paragraphs (b) and (c) of this sub-regulation shall not

apply.".

The proviso to regulation 43 of the principal regulations

shall be deleted.

In paragraph (d) of sub-regulation (8) of regulation 68Q of

the principal regulations, for the words "by the Malta heritage bus."

there shall be substituted the words "by the Malta heritage bus;", and

immediately thereafter there shall be added the following new

paragraphs

"(e)

it has a fully functioning air conditioning system;

and

(f)

it is fitted with a tracking device in accordance with

the specifications published by the Authority from time to

time.".

In sub-regulation (1) of regulation 117 of the principal

regulations, for the words "For a period of six years" there shall be

substituted the words "For a period of eleven years".
