Approval and Market Surveillance of Two- or Three-Wheel

Vehicles and Quadricycles Regulations (Amendment), 2017

IN exercise of the powers conferred by articles 38 to 40 of the

Product Safety Act, the Minister for Social Dialogue, Consumer

Affairs and Civil Liberties, on the advice of the Malta Competition

and Consumer Affairs Authority and the Minister for Transport and

Infrastructure, on the advice of the Authority for Transport in Malta,

have made the following regulations:-

The title of these regulations is Approval and Market Citation.

Surveillance of Two-or Three-Wheel Vehicles and Quadricycles

(Amendment) Regulations, 2017 and these regulations shall be read

and construed as one with the Approval and Market Surveillance of

Two- or Three-Wheel Vehicles and Quadricycles Regulations S.L. 427.43.

hereinafter referred to as "the principal regulations".

Regulation 2 of the principal regulations shall be amended Amends

regulation 2 of

as follows

the principal

regulations.

(a)

in paragraph (a) thereof the words "on the approval

and market surveillance of two- or three-wheel vehicles and

quadricycles; and" shall be substituted by the words "on the

approval and market surveillance of two- or three-wheel vehicles

and quadricycles;";

(b) in paragraph (b) thereof the words "and Passengers of

Motor Cycles and Mopeds." shall be substituted by the words

"and Passengers of Motor Cycles and Mopeds;"; and

(c)

immediately after paragraph (b) thereof there shall be

inserted the following new paragraphs

"(c) Commission Delegated Regulation (EU) No

3/2014 of 24 October 2013 supplementing Regulation

(EU) No 168/2013 of the European Parliament and of the

Council with regard to vehicle functional safety

requirements for the approval of two- or three-wheel

vehicles and quadricycles;

(d) Commission Delegated Regulation (EU) No

44/2014 of 21 November 2013 supplementing Regulation

(EU) No 168/2013 of the European Parliament and of the

Council with regard to the vehicle construction and general

requirements for the approval of two- or three-wheel

vehicles and quadricycles;

(e) Commission Delegated Regulation (EU) No

134/2014 of 16 December 2013 supplementing Regulation

(EU) No 168/2013 of the European Parliament and of the

Council with regard to environmental and propulsion unit

performance requirements and amending Annex V thereof;

and

(f) Commission Implementing Regulation (EU)

No 901/2014 of 18 July 2014 implementing Regulation

(EU) No 168/2013 of the European Parliament and of the

Council with regard to the administrative requirements for

the approval and market surveillance of two- or three-

wheel vehicles and quadricycles.".
