Establishment of the National Register of Traditional Agro-food

Products of Malta (Amendment) Regulations, 2017

IN exercise of the powers conferred by article 38 of the Product

Safety Act, the Minister for Social Dialogue, Consumer Affairs and

Civil Liberties in consultation with the Minister for Sustainable

Development, the Environment and Climate Change, has made the

following regulations:-

The title of these regulations is the Establishment of the Citation.

National Register of Traditional Agro-food Products of Malta

(Amendment) Regulations, 2017, and these regulations shall be read

and construed as one with the Establishment of the National Register S.L. 427.89.

products";

in sub-regulation (2) thereof, for the words "in the

approved products";

(c)

in sub-regulation (3) thereof, for the words "within

the list of approved products mentioned above" there shall be

substituted the words "in the Register"; and

(d)

sub-regulation (4) thereof shall be substituted by

the following new sub-regulation

"(4) Starting from the date of the coming into

force of these regulations and without prejudice to

Regulation (EU) No 1151/2012 on quality schemes for

agricultural products and foodstuffs, the inclusion of a

name in the Register shall preclude any person from

lodging an application for protection of that name under

EU and national laws concerning intellectual and industrial

property.".
