Correction of Laws Order, 2017

(Excise Duty Act, Cap. 382)

IN exercise of the powers conferred by article 7(3) of the Statute

Law Revision Act, 1980, the Law Commission has made the

following corrections

The Excise Duty Act shall be corrected as follows

Corrections to

the Excise Duty

Act.

(a)

immediately after the second proviso in sub-article

(1) of article 16 thereof, there shall be added the following

proviso

''Provided further that one-third of the fine (multa)

shall be deemed as a civil debt owed and payable to the

Department of Customs.'';

(b)

in the ''Description of goods'' column in Schedule

Five F thereto, the item

''- excluding bio-degradable sacks and bags in accordance

with MSA EN 13432:2000, MSA EN 14046:2003, MSA EN

14047:2003 and MSA EN 14048:2003;''

is repeated twice, and consequently the second item is to be

removed;

(c)

in paragraphs (b) and (c) pf sub-regulation (3) of

regulation 12 of Part A of the Sixth Schedule, for the words ''as

specified in the Annex after the Fifth Schedule'' there shall be

substituted the words ''as specified in the Annex to these

regulations'';

(d)

the Annex, which comprises five forms and

explanatory notes, the heading of which starts with the words

''MALTA

INTERNAL

ADMINISTRATIVE

ACCOMPANYING DOCUMENT'', is to be placed immediately

after the proviso to regulation 18 of Part A of the Sixth

Schedule;

(e)

in sub-regulation (3) of regulation 6 in Part C -

Manufactured Tobacco Regulations - in the Sixth Schedule

thereto, for the words "affixed to the container" there shall be

substituted the words "affixed to the packet";

(f)

in sub-paragraph (i) of paragraph (b) of sub-

regulation (2) of regulation 17 in Part D - Mineral Oils

Regulations - in the Sixth Schedule thereto, for the words "for

gas oils intended to be used" there shall be substituted the words

"for gas oils, excluding gas oils intended to be used";

(g)

the fourteen forms contained in the Annex, the first

form of which is Form STA 1, shall be placed immediately after

regulation 38 in Part D of the Sixth Schedule thereto;

(h)

immediately after regulation 15, and before the

words ''Table 1'' in Part H of the Sixth Schedule thereto, there

shall be added the words ''Annex I''; and

(i)

the new Seventh Schedule and Eighth Schedule, as

added by Act XVI of 2017, shall be placed immediately after

Part H of the Sixth Schedule thereto.

The Minister for Justice, Culture and Local Government

has appointed the following dates as the dates on which the

corrections made by the Law Commission and published by this

Legal Notice shall be deemed to have come into force

(a)

paragraphs (a), (d), (e), (g) and (h) of article 1 shall

be deemed to have come into force on 13th April, 2017;

(b)

paragraphs (b), (f) and (i) of article 1 shall be

deemed to have come into force on 17th October, 2016; and

(c)

paragraph (c) of article 1 shall be deemed to have

come into force on the 25th November, 2004.
