Quality of Fuels (Amendment) Regulations, 2017

IN EXERCISE of the powers conferred by article 37(1) of the

Regulator for Energy and Water Services Act, by article 43 of the

Authority for Transport in Malta Act and by article 374 of the

Merchant Shipping Act, the Minister responsible for Energy and Water

Management, and the Minister responsible for Transport,

Infrastructure and Capital Projects, after consultation with the

Regulator for Energy and Water Services, and the Authority for

Transport in Malta, have made the following regulations:-

(1) The title of these regulations is the Quality of Fuels Citation and

(Amendment) Regulations, 2017 and they shall be read and construed commencement.

1(7) (b) of Directive (EU) 2015/1513.

"(1) The Regulator for Energy and Water Services

shall monitor compliance with the requirements of

regulations 4 and 5, in respect of petrol and diesel fuels, on

the basis of the analytical methods referred to in Schedules

I and II respectively. In respect of gas oils intended for use

by non-road mobile machinery, agricultural and forestry

tractors and recreational craft, the Regulator for Energy and

Water Services shall monitor compliance on the basis of the

analytical methods referred to in standard EN ISO 8754.".

(b)

in sub-regulation (3) thereof, the following words

"By the end of April of each year, the Regulator for

Energy and Water Resources shall submit to the Minister

responsible for resources a report on

(a)

national fuel quality data for the

preceding calendar year the format of which shall be

consistent with that described in the relevant

European standard;",

shall be substituted by the following

"By the 31st August of each year, the Regulator, after

consultation with the Minister responsible for Energy, shall

submit to the Commission a report on

(a)

national fuel quality data for the

preceding calendar year;".
