Industrial Emissions (Integrated Pollution Prevention and Control)

(Amendment No. 2) Regulations, 2017

By virtue of the powers conferred by article 54 of the

Environment Protection Act, the Minister for Sustainable

Development, the Environment and Climate Change, in consultation

with the Environment and Resources Authority, has made the

following regulations:-

Reg. 1 Citation. — 110 tal-2017 – Regolamenti tal-2017 li jemendaw ir-regolamenti dwar il-Prevenzjoni u l-kontroll Integrat tat-Tniġġis tal-Emissjonijiet Industrijali (Emenda Nru. 2) Open official source

The title of these regulations is the Industrial Emissions

(Integrated Pollution Prevention and Control) (Amendment No. 2)

Regulations, 2017, and they shall be read and construed as one with

the Industrial Emissions (Integrated Pollution Prevention and

Control) Regulations, hereinafter referred to as "the principal

regulations".

Reg. 2 Amends regulation 8 of the principal regulations. — 110 tal-2017 – Regolamenti tal-2017 li jemendaw ir-regolamenti dwar il-Prevenzjoni u l-kontroll Integrat tat-Tniġġis tal-Emissjonijiet Industrijali (Emenda Nru. 2) Open official source

In sub-regulation (4) of regulation 8 of the principal

regulations, for the two paragraphs where the first one starts with the

words "The competent authority shall document in an annex" to the

second paragraph which ends with the words "to the Industrial

Emissions (Framework) Regulations, where applicable." they shall be

substituted with the following

"The competent authority shall document in an annex to

the permit conditions the reasons for the application of the first

sub-paragraph of paragraph (4) of this regulation including the

result of the assessment and the justification for the conditions

imposed.

The emission limit values set in accordance with the first

sub-paragraph of paragraph (4) of this regulation shall,

however, not exceed the emission limit values set out in the

Schedule to the Industrial Emissions (Framework) Regulations,

where applicable.".
