Electricity Market (Amendment No. 2) Regulations, 2016

IN exercise of the powers conferred by article 37(1) of the

Regulator for Energy and Water Services Act, the Prime Minister,

after consultation with the Regulator for Energy and Water Services,

has made the following regulations:-

The title of these regulations is the Electricity Market

(Amendment No. 2) Regulations, 2016, and these regulations shall be

read and construed as one with the Electricity Market Regulations,

hereinafter referred to as "the principal regulations".

In paragraph (c) of sub-regulation (1) of regulation 4 of the

principal regulations, for the words "distribution system operator."

there shall be substituted the words "distribution system operator:",

and immediately thereafter there shall be added the following new

proviso

"Provided that, in view of the derogations from the

application of Articles 32 and 33 of Directive 2009/72/EC

granted to Malta pursuant to Article 44 of Directive 2009/72/EC

and until such time as the aforesaid derogations remain in force,

the licence for the supply of electricity shall be issued only to

the distribution system operator, designated in accordance with

regulation 13(1).".
