Housing Authority (Transfer of Assets) (No. 6) Order, 2016

IN exercise of the powers conferred by article 12 of the Housing

Authority Act, the President of Malta has made the following order:-

The title of this order is the Housing Authority (Transfer of

Assets) (No. 6) Order, 2016.

The property described in article 4 of this Order is hereby

specified for the purpose of article 12 of the Housing Authority Act.

The property specified in article 2 of this Order shall be

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 22nd November, 2016.

The property referred to in article 2 of this Order is the

following, that is to say

A block, known as Block A3, consisting of six

flats, of which three are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq l-

Isptar, Attard. This block is bounded on the South-West and on

the South-East by a public open space and on the North-East by

a public passage off Triq l-Isptar. Flat numbered 2 is registered

with the Government as Tenement bearing number 72717 and

flats numbered 4 and 5 are registered with the Government as

Tenements bearing numbers 72719 and 72720 respectively. This

block falls on Government property formerly part of Tenement

No. 50195 and the whole block is shown edged in red and

marked “BLOCK A3” on plan P.D. 2016_0885. (HAA 29/

2016).

A block, known as Entrance G Block 2, consisting

of eight flats registered with the Government as Tenements

bearing numbers 77147 to 77154, in Binja Vista, Triq Dom

Mawru Inguanez, Birkirkara. This block is bounded on the

South-East and on the North-West by Government property and

on the South-West by Triq Dom Mawru Inguanez. This block

falls on Government property formerly part of Tenement No.

83014, on land acquired by Deed No. 216/95 dated 23rd August

1995 in the acts of Notary V. Miceli and on land acquired by

Schedule of Deposit No. 42 dated 14th June 2000. The whole

block is shown edged in red and marked “BLOCK 2” on plan

P.D. 184_92_11. (HAA 98/2016).

Part of a block, known as Block A1, which part

consists of three flats and common parts in Triq Mater Dei Boni

Consiglii, Fgura and this block is bounded on the South-East by

a public open space, on the North-West by property in the

course of acquisition by the Government and on the South-West

by Triq Mater Boni Consiglii. Flats numbered 2, 4 and 6 are

registered with the Government as Tenements bearing numbers

72798, 72800 and 72802 respectively. This part of the block

falls on Government property acquired by Deed No. 30/80 dated

12th March 1980 in the acts of Notary A. Grech and by

President’s Declaration No. 1130 dated 1st December 2003 and

is shown edged in red on plan P.D. 2013_697_2. (HAA 232/

2012).

A block, known as Block 7, consisting of three

dwellings registered with the Government as Tenements bearing

numbers 63526 to 63528, in Triq Dun Karm Azzopardi, Isla.

This block is bounded on the South-East by Triq San Ġiljan, on

the South-West by Triq Dun Karm Azzopardi and on the North-

East by Triq Miġja tal-Papa. This block falls on Government

property acquired by President’s Declaration No. 65 dated 23rd

January 2012 and the whole block is shown edged in red and

marked “BLOCK 7” on plan P.D. 2016_1132. (HAA 8/2015).

A house, known as 59 in Triq id-Duluri, Isla, and is

bounded on the South-East by Triq id-Duluri and on the North-

West and on the South-West by private property. This house

falls on Government property acquired by President’s

Declaration No. 1088 dated 6th October 2016 and is shown

edged in red on plans HA 899/2015 and HA 900/2015. (HA 58/

86).

A plot of land, known as H.O.S. Plots 1 to 9 in Triq

it-Tiġrija and Triq Nerik Sacco, Marsa and is bounded on the

North-East by Government property, on the South-East by Triq

Nerik Sacco and on the South-West by Triq it-Tiġrija. These

plots fall on Government property acquired by President’s

Declaration No. 526 dated 11th June 2015, by Deed No. 43/80

dated 19th March 1980 in the acts of Notary A. Grech and by

Deed No. 192/84 dated 7th March 1984 in the acts of Notary F.

Portelli and are shown edged in red on plan P.D. 2015_0949.

A plot of land known as 21, ‘Linton’ (Plot 28) in

Triq il-Mitħna l-Ġdida, Ta’ Pennellu, Mellieħa, having an area

of approximately 199 square metres, and is bounded on the

North-East by Triq il-Mitħna l-Ġdida, on the North-West and on

the South-East by property transferred to the Housing Authority.

The plot is subject to a temporary emphyteusis as per Deed No.

235/69 dated 11th August 1969 in the acts of Notary A. Grech.

The plot falls on part of Government property formerly

registered as Tenement No. 50222 portion 5 and is registered in

the Estate Management Department records as Tenement No.

65347 and is shown edged in red on plan L.D. 383/91/6. (HAP

1/2015).

A block, known as Block D3, consisting of nine

flats, of which three are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq il-

Kultellazz, Mosta. This block is bounded on the South by Triq

id-Dawr, on the East by Triq il-Kultellazz and on the North by a

public open space. Flats numbered 1 and 2 are registered with

the Government as Tenements bearing numbers 70851 and

70852 respectively and flats numbered 4 to 8 are registered with

the Government as Tenements numbered 70855 to 70858. This

block falls on Government property acquired by Deed No. 7/75

dated 15th January 1975 in the acts of Notary A. Grech and the

whole block is shown edged in red and marked “BLOCK D3”

on plan P.D. 2016_1107. (HAA 88/2016).

A block, known as Block F2, consisting of six flats

of which four are being excluded from the transfer as they were

already transferred by a previous legal notice, in Triq in-Nasba,

Mosta. This block is bounded on the South-East by Triq in-

Nasba, and on the North-East and on the South-West by a public

open space. Flats numbered 2 and 6 are registered with the

Government as Tenements bearing numbers 71487 and 71491

respectively. This block falls on Government property acquired

by Deed No. 7/75 dated 15th January 1975 in the acts of Notary

A. Grech and the whole block is shown edged in red and marked

“BLOCK F2” on plan P.D. 2016_1089. (HAA 89/2016).

(10) A block, known as Block F4, consisting of six flats

of which one is being excluded from the transfer as it was

already transferred by a previous legal notice, in Triq in-Nasba,

Mosta. This block is bounded on the North-West by Triq in-

Nasba, and on the North-East and on the South-West by a public

open space. Flats numbered 1 to 4 are registered with the

Government as Tenements bearing numbers 71498 to 71501 and

flat numbered 6 is registered with the Government as Tenement

bearing number 71503. This block falls on Government

property acquired by Deed No. 7/75 dated 15th January 1975 in

the acts of Notary A. Grech and the whole block is shown edged

in red and marked “BLOCK F4” on plan P.D. 2016_1090.

(11) A block, known as Block K2, consisting of six flats

of which two are being excluded from the transfer as they were

already transferred by a previous legal notice, in Triq it-

Trinċetta, Mosta. This block is bounded on the South-West and

on the North-West by a public open space and on the North-East

by Triq it-Trinċetta. Flats numbered 1 to 4 are registered with

the Government as Tenements bearing numbers 73453 to 73456.

This block falls on Government property acquired by Deed No.

7/75 dated 15th January 1975 in the acts of Notary A. Grech and

the whole block is shown edged in red and marked “BLOCK

K2” on plan P.D. 2016_1088. (HAA 92/2016).

(12) A block, known as Block 3, consisting of ten flats

and twelve garages in Triq Ġibiltà, Naxxar and this block is

bounded on the North-West by Ġnien l-Unjoni Ewropea, on the

South-West by Triq il-Marokk and on the South-East by Triq

Ġibiltà. This block falls on Government property acquired by

President’s Declaration No. 704 dated 7th July 2016, by

President’s Declaration 70 dated 23rd January 2012 and by

Deed No. 199/92 dated 22nd July 1992 and is shown edged in

red on plan P.D. 142_81_23. (HAM 3/94 Vol II).

(13) A plot of land, known as H.O.S. Plots 39 to 57, in

Triq Dun Salvatore Zarb, Għargħur and is bounded on the

North-West in part by property transferred to the Housing

Authority and in part by Government property, on the South-

East by Triq Dun Salvatore Zarb and on the South-West by

property transferred to the Housing Authority. These plots fall

on Government property acquired by land formerly part of

Tenement No. 50171, by land acquired by President’s

Declarations 530 and 531 both dated 11th June 2015, by land

acquired by Deed No. 219/1993 dated 25th August 1993 in the

acts of Notary Miceli and by land acquired by Deed No. 10/94

dated 26th January 1994. The whole plot of land is shown edged

in red on plan P.D. 2009_140_1. (HAM 167/82).

(14) A block, known as Block B, consisting of eighteen

flats of which twelve are being excluded from the transfer as

they were already transferred by a previous legal notice, in Triq

il-Bwar, Għaxaq. This block is bounded on the North-East by a

public open space, on the North-West by Triq il-Miksur and on

the South-East by Triq il-Bwar. Flats numbered 2, 4, 8, 9, 16

and 18 are registered with the Government as Tenements

bearing numbers 69454, 69456, 69460, 69461, 69468 and

69470 respectively. This block falls on Government property

acquired by Deed No. 175/79/G dated 15th September 1979 in

the acts of Notary A. Grech and the whole block is shown edged

in red and marked “BLOCK B” on plan P.D. 66_78_13. (HAA

4/2016, HAA 5/2016).

(15) A block, known as Block A2, consisting of twelve

flats of which seven are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq Joe

Gasan, Pietà. This block is bounded on the North-West by

Pjazza Madonna ta’ Fatima, on the South-East by Triq Joe

Gasan and on the South-West by Government property. Flats

numbered 2, 5, 9, 10 and 12 are registered with the Government

as Tenements bearing numbers 69727, 69730, 69734, 69735 and

69737 respectively. This block falls on Government property

formerly registered as Tenement No. 50026 and the whole block

is shown edged in red and marked “BLOCK A2” on plan P.D.

(16) A block, known as Block 3, consisting of two flats

which are being excluded from the transfer as they were already

transferred by a previous legal notice, in Misraħ l-Awrikarja,

San Ġwann. The transfer shall consist of the remaining

undivided shares of common parts and roof. This block is

bounded on the South by Triq iċ-Ċedru, on the North by Misraħ

l-Awrikarja and on the East by property transferred to the

Housing Authority. This block falls on Government property

acquired by Deed No. 422 dated 11th December 1974 in the acts

of Notary A. Grech and is shown edged in red on plan P.D.

2016_1104. (HAA 114/2015).

(17) A block, known as Entrance I Block 2, consisting

of eight flats of which one is being excluded from the transfer as

it was already transferred by a previous legal notice, in Binja

Vista, Triq Dom Mawru Inguanez, Santa Venera. This block is

bounded on the North-West by Triq Ġużepp Dimech Debono,

on the South-East by Government property and on the South-

West by Triq Dom Mawru Inguanez. Flats numbered 1 and 2 are

registered with the Government as Tenements bearing numbers

77163 and 77164 respectively and flats numbered 4 to 8 are

registered with the Government as Tenements bearing numbers

77166 to 77170. This block falls on Government property

acquired by Deed No. 216/95 dated 23rd August 1995 in the

acts of Notary V. Miceli and the whole block is shown edged in

red and marked “BLOCK 2” on plan P.D. 184_92_9. (HAA 100/

2016).

(18) A block, known as Entrance F Block 2, consisting

of eight flats registered with the Government as Tenements

bearing numbers 77139 to 77146, in Binja Vista, Triq Dom

Mawru Inguanez, Santa Venera. This block is bounded on the

South-East by property of the Housing Authority or its

successors in title, on the North-West by Government property

and on the South-West by Triq Dom Mawru Inguanez. This

block falls on Government property acquired by Deed No. 216/

95 dated 23rd August 1995 in the acts of Notary V. Miceli and

on land acquired by Schedule of Deposit No. 42 dated 14th June

2000. The whole block is shown edged in red and marked

“Block 2” on plan P.D. 184_92_8. (HAA 156/2012).

(19) A block, known as Entrance H Block 2, consisting

of eight flats of which one is being excluded from the transfer as

it was already transferred by a previous legal notice, in Binja

Vista, Triq Dom Mawru Inguanez, Santa Venera. This block is

bounded on the North-East by property of the Housing

Authority or its successors in title, on the North-West by

Government property and on the South-West by Triq Dom

Mawru Inguanez. Flats numbered 1 to 5 are registered with the

Government as Tenements bearing numbers 77155 to 77159 and

flats numbered 7 and 8 are registered with the Government as

Tenements bearing numbers 77161 and 77162 respectively. This

block falls on Government property formerly part of Tenement

No. 83014 and on land acquired by Deed No. 216/95 dated 23rd

August 1995 in the acts of Notary V. Miceli. The whole block is

shown edged in red and marked “Block 2” on plan P.D.

(20) A block, known as Entrance N, Block 3, consisting

of two flats registered with the Government as Tenements

bearing numbers 78363 and 78364 respectively, in Triq Patri

Gustin Sant, Santa Venera. This block is bounded on the North-

West by Triq Patri Gustin Sant, on the South-West by

Government property and on the North-East by property in the

course of acquisition by the Government. This block falls on

Government property acquired by Schedule of Deposit dated

22nd August 1996 and the whole block is shown edged in red

and marked “BLOCK 3” on plan P.D. 150_95_5. (HAA 44/

2016).

(21) A block, known as Entrance O, Block 3, consisting

of four flats of which two are being excluded from the transfer

as they were already transferred by a previous legal notice, in

Triq Patri Gustin Sant, Santa Venera. This block is bounded on

the North-West by Triq Patri Gustin Sant, on the North-East by

Government property and on the South-West by property in the

course of acquisition by the Government. Flats numbered 2 and

4 are registered with the Government as Tenements bearing

numbers 78366 and 78368 respectively. This block falls on

Government property acquired by Schedule of Deposit dated

22nd August 1996 and the whole block is shown edged in red

and marked “BLOCK 3” on plan P.D. 150_95_6. (HAA 173/

2013).

(22) Two houses, known as 36 (now 3) and 37 (now 1),

and are registered with the Government as Tenements bearing

numbers 67428 and 67429 respectively, in Triq Xeht il-Forom,

Żejtun. These houses are bounded on the North-East by

Mogħdija Hannewwija, on the South-West by Triq Xeht il-

Forom and on the North-West in part by Government property

and in part by Triq il-Fossa tal-Qamħ. These houses fall on

Government property acquired by Deed No. 229/71 dated 5th

June 1971 in the acts of Notary A. Grech and are shown edged

in red and marked “House 37” and “House 36” on plan HA

1189/2015. (HAA 23/2015).
