Investment Services Act (Fees) (Amendment No. 2)

Regulations, 2016

IN exercise of the powers conferred by article 12 of the

Investment Services Act, the Minister for Finance, acting on the

advice of the Malta Financial Services Authority, has made the

following regulations:-

The title of these regulations is the Investment Services Citation.

Act (Fees) (Amendment No. 2) Regulations, 2016, and these

regulations shall be read and construed as one with the Investment S.L. 370.03

Services Act (Fees) Regulations, hereinafter referred to as "the

principal regulations".

In sub-regulation (1) of regulation 2 of the principal Amends

regulations, immediately after the definition "professional client" regulation

the principal

there shall be added the following new definitions

regulations.

" "retail AIF" means an AIF which is marketed exclusively

to retail clients as defined herein;

"retail client" means a client who is not a professional

client as defined herein;".

In the first column of paragraph (b) of the Schedule to the Amends the

principal regulations, for the words "UCITS Schemes and non- Schedule

principal

UCITS Retail Schemes" there shall be substituted the words "UCITS regulations.

Schemes, non-UCITS Retail Schemes and Retail AIFs".
