ELECTRONIC COMMUNICATIONS (REGULATION) ACT

Electronic Communications Networks and Services (General)

(Amendment) (No. 2) Regulations, 2016

IN exercise of the powers conferred by articles 34 and 37 of the

Electronic Communications (Regulation) Act, the Minister for

Competitiveness and Digital, Maritime and Services Economy, after

consultation with the Minister for Finance, has made the following

regulations:-

(1)

The title of these regulations is the Electronic Citation and

Communications Networks and Services (General) (Amendment) commencement.

(No. 2) Regulations, 2016, and these regulations shall be read and

construed as one with the Electronic Communications Networks and S.L. 399.28

Services (General) Regulations, hereinafter referred to as "the

principal regulations".

(2) The amendments to Part A of the Eight Schedule to the

principal regulations shall be deemed to have come into force on 1st

July 2016.

(3) The amendments to Part C of the Eight Schedule to the

principal regulations shall come into force on the 1st January 2017.

The Eighth Schedule to the principal regulations shall be Amends the

Eighth Schedule

(a)

Part A thereof shall be amended as follows

(i) in paragraph (c) thereof, for the words

"€11,645 plus €0.35 per subscriber" there shall be

substituted the figure "€11,645";

(ii) for the following proviso thereto

"Furthermore, undertakings providing any of the

services under (b), (c), (d), (e) or (g) above shall also pay

to the Authority the following

(i) one and one-half per cent of the first

twenty-three million and two hundred and ninety-

three thousand and seven hundred and thirty-five

euro (€23,293,735) tranche of the total gross

revenue or part thereof,

(ii) one per cent of the second twenty-three

million and two hundred and ninety-three thousand

and seven hundred and thirty-five euro

(€23,293,735) tranche of the total gross revenue or

part thereof, and

(iii) one-half per cent of any remaining gross

revenue."

to the Authority 1.1% of the total gross revenue."; and

Part C thereof shall be substituted by the following
