INVESTMENT SERVICES ACT

(CAP. 370)

Investment Services Act (Exemption) (Amendment)

Regulations, 2016

IN exercise of the powers conferred by article 12 of the

Investment Services Act, the Minister for Finance, acting on the

advice of the Malta Financial Services Authority, has made the

following regulations:-

The title of these regulations is the Investment Services Citation.

Act (Exemption) (Amendment) Regulations, 2016, and these

regulations shall be read and construed as one with the Investment S.L. 370.02

Services Act (Exemption) Regulations, hereinafter referred to as "the

principal regulations".

In sub-regulation (1) of regulation 2 of the principal Amends

regulations, immediately after the definition "European investment regulation

the principal

firm" there shall be added the following new definition

regulations.

" "List of Notified AIFs" shall be understood as referring

to the List of Notified AIFs in good standing which is held by

the competent authority on its website in terms of the

Investment Services Act (List of Notified AIFs) Regulations,

2016;".

2. Sub-regulation (1) of regulation 5 of the principal Amends

regulation 5 of

regulations shall be amended as follows

the principal

regulations.

(a) paragraphs (d) and (e) thereof shall be renumbered

as paragraphs (e) and (f) respectively; and

(b) immediately after paragraph (c) thereof, there shall

be added the following new paragraph

"(d) a scheme established as an alternative

investment fund and managed by an alternative investment

fund manager that has been included by the competent

authority on the List of Notified AIFs in terms of the

Investment Services Act (List of Notified AIFs)

Regulations, 2016;".
