Liquefied Petroleum Gas Market (Amendment)

Regulations, 2016

IN exercise of the powers conferred by article 37(1) of the

Regulator for Energy and Water Services Act, the Minister for Energy

and Health, after consultation with the Regulator for Energy and

Water Services, has made the following regulations:-

The title of these regulations is the Liquefied Petroleum

Gas Market (Amendment) Regulations, 2016, and these regulations

shall be read and construed as one with the Liquefied Petroleum Gas

Market Regulations, hereinafter referred to as "the principal

regulations".

Regulation 5A of the principal regulations shall be

amended as follows

(a)

in the proviso to sub-regulation (4) thereof, for the

words "delivered to such final customer." there shall be

substituted the words "delivered to such final customer:", and

immediately after that proviso, as amended, there shall be added

the following new proviso

"Provided further that the deposit as a guarantee for

the restitution of a portable cylinder of a capacity of twelve

(12) kilograms delivered to a final customer or any other

person acting on his behalf, shall in all cases be of fifteen

euro (€15) and the reimbursement of such deposit shall

also be of fifteen euro (€15) when a final customer, or any

other person acting on his behalf, is not in possession of a

receipt. In the event that a final customer is in possession

of a receipt indicating a higher amount than fifteen euro

(€15), then such final customer, or any other person acting

on his behalf, shall be reimbursed such higher amount.";

and

(b)

in sub-regulation (6) thereof, for the words "in

terms of such deposit." there shall be substituted the words "in

terms of such deposit, and the capacity in kilograms of such

portable cylinder.".
