ENVIRONMENT AND DEVELOPMENT PLANNING ACT

Development Planning (Procedure for Minor Modifications to

Subsidiary Plans) (Amendment) Regulations, 2015

IN EXERCISE of the powers conferred by articles 61 and 62 of

the Environment and Development Planning Act, the Minister for

Sustainable Development, the Environment and Climate Change and

the Parliamentary Secretary for Planning and Simplification of

Administrative Processes, after consultation with the Malta

Environment and Planning Authority, have made the following

regulations:-

The title of these regulations is the Development Planning Citation.

(Procedure for Minor Modifications to Subsidiary Plans)

(Amendment) Regulations, 2015, and these regulations shall be read

and construed as one with the Development Planning (Procedure for S.L. 504.76

Minor Modifications to Subsidiary Plans) Regulations, hereinafter

referred to as "the principal regulations".

Regulation 4 of the principal regulations shall be amended Amends

regulation 4 of

as follows

the principal

regulations.

(a)

paragraph (a) of sub-regulation (2) thereof shall be

substituted by the following

"(a) in the case of applications submitted in terms

of regulation 3(a) and regulation 3(b), he has notified the

third party owners within the same street of his intention

by registered letter and a copy of such letter shall

accompany his application. This letter shall also have

attached a map, signed by the applicant’s architect and

cross referred to the location of each third party ownership.

The extent of the area of notification shall lie along the

whole stretch affected by the change in alignment and, or

change in zoning;";

(b)

in sub-regulation (3) thereof

(i) the words "or if the proposed change is likely

to affect third parties" shall be deleted;

(ii) paragraph (a) thereof shall be deleted;

(iii) paragraph (b) thereof shall be renumbered as

paragraph (a);

(iv) paragraph (c) thereof shall be renumbered as

paragraph (b) and for the words "indicated in paragraph

(b)" there shall be substituted the words "indicated in

paragraph (a)"; and

(v)

paragraph (d) thereof shall be deleted.

Regulation 5 of the principal regulations shall be amended

(a)

sub-regulation (7) thereof shall be deleted; and

(b)

sub-regulation (8) thereof shall be renumbered as

sub-regulation (7).

In sub-regulation (2) of regulation 6 of the principal

regulations, for the words "set out in regulation 5(2), (3) and (5) to

(8)" there shall be substituted the words "set out in regulation 5(2),

(3) and (5) to (7)".
