Conservation of Wild Birds (Declaration on a derogation for a

2015 Autumn live-capturing season for Finches)

Regulations, 2015

BY VIRTUE of the powers conferred by article 61 of the

Environment and Development Planning Act, and in terms of the

provisions of regulation 10(6) of the Conservation of Wild Birds

Regulations, and of regulations 4 and 7 of the Conservation of Wild

Birds (Framework for Allowing a Derogation Opening an Autumn

Live-Capturing Season for Finches) Regulations, 2014, the Minister

for Sustainable Development, the Environment and Climate Change

has made the following regulations:-

The title of these regulations is the Conservation of Wild Citation.

Birds (Declaration on a Derogation for a 2015 Autumn Live-

Capturing Season for Finches) Regulations, 2015.

Terms and expressions used in these regulations, unless the Interpretation.

context otherwise requires, shall have the same meaning as given to

them in the Conservation of Wild Birds Regulations, hereinafter S.L. 504.71

referred to as the "the Wild Birds Regulations", and in the

Conservation of Wild Birds (Framework for Allowing a Derogation S.L. 504.124

Opening an Autumn Live-Capturing Season for Finches) Regulations.

For the purposes of establishing the period for the live- Establishment

capturing of wild birds under regulation 10(6)(ii) and (iii) of the Wild of season.

Birds Regulations, and for the purpose of these regulations the period

for the live-capturing of Finches for the year 2015, hereinafter

referred to as "the Autumn live-capturing season", shall be on the

following dates

live-capturing of Linnet, Goldfinch, Greenfinch, Siskin,

Hawfinch, Chaffinch and Serin between the 20th October 2015

and the 31st December 2015, both dates included.

For the purposes of these regulations, the Autumn live- Live-Capturing

capturing season shall be in accordance with the provisions of the according

framework.

Conservation of Wild Birds (Framework for Allowing a Derogation S.L. 504.124

Opening an Autumn Live-Capturing Season for Finches),

Regulations.

The Autumn live-Capturing license, which shall be

issued upon the payment of a nominal fee of fifty-five euro (€55),

shall set the overall seasonal bag limit for the Autumn live-capturing

season at 12,000 for Linnet, 800 for Goldfinch, 4,500 for Greenfinch,

2,350 for Siskin, 500 for Hawfinch, 5,000 for Chaffinch and 2,350 for

Serin as the total number of birds which may be captured under the

authority of all issued licences taken together.

(2) The Autumn live-capturing licence shall set the live-

capturing season’s bag limit to ten (10) finches for each Autumn live-

capturing licence or however many below this number might have

been captured before the season is closed.
