Housing Authority (Transfer of Assets) (No. 5) Order, 2015

IN exercise of the powers conferred by article 12 of the Housing

Authority Act, the President of Malta has made the following order:-

The title of this order is the Housing Authority (Transfer of Citation.

Assets) (No. 5) Order, 2015.

The property described in article 4 of this order is hereby Specified

specified for the purpose of article 12 of the Housing Authority Act. property.

The property specified in article 2 of this order shall be Appointed day.

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 3rd of August, 2015.

The property referred to in article 2 of this order is the Description of

specified

following, that is to say

property.

(1)

A block, consisting of ten flats of which one is

being excluded from the transfer as it was already transferred by

a previous legal notice, at Fuq il-Fortini, Birgu. This block is

bounded on the East by Triq il-Fortini, on the North by a public

open space and on the West by Government property. Flats

numbered 1 to 3 are registered with the Government as

Tenements bearing numbers 67659 to 67661 and flats numbered

5 to 10 are registered with the Government as Tenements

bearing numbers 67663 to 67668. This block falls on

Government property formerly part of Tenement No. 62006 and

on part of ex-Services Tenement No. 16356 and is shown edged

in red on plan P.D. 2015_0551. (HAA 3/2015).

A block, known as Block E, Entrance A and C in

Triq il-Mons Pawlu Galea, Birgu and this block falls on

Government property acquired by Deed No. 60/79/G dated 21st

March 1979, by Deed No. 209/76/G dated 7th July 1976, by

Deed No. 185 dated 19th November 1980 and by Deed No. 187/

78/G dated 9th August 1978 all in the acts of Notary A. Grech

and the whole block is shown edged in red and marked “Block

E” on plan P.D. 2011_938_1, as follows

(a)

Entrance A consists of six flats of which one

is being excluded from the transfer as it was already

transferred by a previous legal notice and is bounded on

the North-West by Triq Peppi Vella, on the South-West by

Triq il-Qalb ta’ Ġesu and on the South-East by Triq il-

Mons Pawlu Galea. Flats numbered 1 and 2 are registered

with the Government as Tenements bearing numbers

72668 and 72669 respectively and flats numbered 4 to 6

are registered with the Government as Tenements bearing

numbers 72671 to 72673; and

(b) Entrance C consists of six flats of which one

is being excluded from the transfer as it was already

transferred by a previous legal notice and is bounded on

the North-West by Triq Peppi Vella and on the South-West

by property of the Housing Authority or its successors in

title. Flats numbered 1 and 2 are registered with the

Government as Tenements bearing numbers 72680 and

72681 respectively and flats numbered 4 to 6 are registered

with the Government as Tenements bearing numbers

Two blocks, known as Block A in Triq San

Franġisku Saverju and Block C in Triq il-Port il-Ħieles,

Birżebbuġa and these blocks are shown edged in red and

marked “Block A” and “Block C” on plan P.D. 14_83_14, as

follows

(a) Block A consists of sixteen flats of which one

is being excluded from the transfer as it was already

transferred by a previous legal notice and is bounded on

the South-East and on the South-West by Government

property and on the North-East partly by Government

property and partly by a public passage. Flats numbered 1

to 6 are registered with the Government as Tenements

bearing numbers 69044 to 69049 and flats numbered 8 to

16 are registered with the Government as Tenements

bearing numbers 69051 to 69059. This blocks falls on

Government property acquired by Schedule of Deposit No.

281 dated 30th March 2001, by Schedule of Deposit No.

900 dated 31st January 2001, by Schedule of Deposit No.

61 dated 17th January 2003 and on part of former

Tenement No. 50794; and

(b) Block C consists of sixteen flats of which five

are being excluded from the transfer as they were already

transferred by a previous legal notice and is bounded on

the South-East and on the South-West by Government

property and on the North-East partly by Government

property and partly by a public passage. Flat numbered 3 is

registered with the Government as Tenement No. 72046,

flats numbered 5 and 6 are registered with the Government

as Tenements bearing numbers 72048 and 72049

respectively, flats numbered 8 to 10 are registered with the

Government as Tenements bearing numbers 72051 to

72053 and flats numbered 12 to 16 are registered with the

Government as Tenements bearing numbers 72055 to

72059. This block falls on Government property acquired

by Schedule of Deposit No. 281 dated 30th March 2001,

by Schedule of Deposit No. 900 dated 31st January 2001,

by Schedule of Deposit No. 61 dated 17th January 2003.

A block, known as Block 3, consisting of twelve

flats of which three are being excluded from the transfer as they

were already transferred by a previous legal notice and

excluding the subsoil, in San Ġwann t’Għuxa, Bormla. This

block is bounded on the North-West and on the South-West by

public passages and on the South-East by Government property.

Flats numbered 1 and 2 Entrance A is registered with the

Government as Tenements bearing numbers 68531 and 68532

respectively, flats numbered 4 and 6 Entrance A is registered

with the Government as Tenements bearing numbers 68534 and

68536 respectively, flat numbered 1 Entrance B is registered

with the Government as Tenement No. 68537 and flats

numbered 3 to 6 are registered with the Government as

Tenements bearing numbers 68539 to 68542. The whole block

falls on un-registered Government property and is edged in red

and marked “BLOCK 3” on plan P.D. 23_80_29. (HAA 99/

A block, known as Block 4, consisting of eight flats

of which four are being excluded from the transfer as they were

already transferred by a previous legal notice and excluding the

subsoil, in San Ġwann t’Għuxa, Bormla. This block is bounded

on the South-West and on the South-East by public passages and

on the North-East by Government property. Flats numbered 1

and 2 Entrance A are registered with the Government as

Tenements bearing numbers 68543 and 68544 respectively, flats

numbered 5 and 6 Entrance A are registered with the

Government as Tenements bearing numbers 68547 and 68548,

flats numbered 2 to 4 Entrance B are registered with the

Government as Tenements bearing numbers 68550 to 68552 and

flat numbered 6 Entrance B is registered with the Government

as Tenement No. 68554. The whole block falls on un-registered

Government property and is edged in red and marked “Block

IV” on plan P.D. 23_80_28. (HAA 101/2014, HAA 102/2014).

The administration of six flats, excluding the

subsoil, are registered with the Government as Tenements

bearing numbers 69579 to 69584 in Block 9, San Ġwann

t’Għuxa, Bormla. This block is bounded on the North-East by

Triq Carmelo Mifsud Bonnici, on the North-West by a public

passage and on the South-West by Triq Cetta Mintoff. The

whole block falls on land which is in the course of acquisition

by the Government and is edged in red and marked “BLOCK 9”

on plan P.D. 28_80_31. (HAA 58/2013).

A block, known as Block 10, consisting of nine

flats of which two are being excluded from the transfer as they

were already transferred by a previous legal notice and

excluding the subsoil, in San Ġwann t’Għuxa, Bormla. This

block is bounded on the South-West and on the South-East by

public passages and on the North-West by Triq Carmelo Mifsud

Bonnici. Flats numbered 1 to 3 are registered with the

Government as Tenements bearing numbers 70705 to 70707,

flats numbered 5 and 6 are registered with the Government as

Tenements bearing numbers 70709 and 70710 respectively and

flats numbered 8 and 9 are registered with the Government as

Tenements bearing numbers 70712 and 70713 respectively. This

block falls on Government property and its utile dominium was

acquired by Deed No. 213/91 dated 29th May 1991 in the acts

of Notary V. Miceli and the whole block is shown edged in red

and marked “BLOCK 10” on plan P.D. 28_80_32. (HAA103/

2014).

A block, known as Block 4, consisting of nine flats

of which five are being excluded from the transfer as they were

already transferred by a previous legal notice, in Triq il-Fosos,

Furjana. This block is bounded on the North-East by a public

passage off Triq il-Fosos, on the South-West by a public passage

and on the South-East by Government property. Flats numbered

2 and 4 are registered with the Government as Tenements

bearing numbers 67986 and 67988 respectively and flats

numbered 5 and 6 are registered with the Government as

Tenements bearing numbers 67990 and 67991. This block falls

on Government property formerly part of ex-Services Tenement

No. 16333 and the whole block is edged in red and marked

“BLOCK 4” on plan P.D. 57_93_3. (HAA 173/2012).

Two houses, known as House 34 and House 50 in

Triq San Filippu, Għaxaq and these houses fall on Government

property formerly part of Tenement No. 50001 and are shown

edged in red and marked “House 34, (Now 120)” and “House

50, (Now 104)” on plan H.A. 927/2015, as follows

(a) House 34 is registered with the Government

as Tenement No. 66015 and is bounded on the North by

property of the Housing Authority or its successors in title,

on the West by Triq San Filippu and on the East by

Government property; and

(b) House 50 is registered with the Government

as Tenement No. 66023 and is bounded on the North and

on the South by Government property and on the West by

Triq San Filippu. (HAA 51/2015).

(10) A block, known as Block H, consisting of six flats

that are registered with the Government as Tenements bearing

numbers 73441 to 73446, in Qasam tal-Menhir, off Triq il-

Fieres, Kirkop. This block is bounded on the West by Triq il-

Fieres and on the North and on the South by public passages.

The whole block falls on Government property acquired by

Deed No. 94/75 dated 26th May 1975 in the acts of Notary A.

Grech and is shown edged in red and marked “BLOCK H” on

plan P.D. 48_83_15. (HAA 130/2014).

(11) A house, known as House 6 in Triq it-Tiġrija,

Marsa and is registered with the Government as Tenement No.

71004. This house is bounded on the West and on the East by

property of the Housing Authority or its successors in title and

on the South by Triq it-Tiġrija. This house falls on Government

property acquired by Deed No. 131/79 dated 20th June 1979 in

the acts of Notary A. Grech and is shown edged in red and

marked “House 6” on plan HA 926/2015. (HAA 34/2015).

(12) Three plots of land consisting of Plots 68 to 76,

Plots 89 to 94, Plots 106 and 107 and Plots 111 and 112 in

Mġarr Housing Estate, Mġarr and these plots fall on

Government property acquired by Deed No. 41 dated 30th June

2014 in the acts of Notary D. Charles and on Government

property formerly part of Tenement No. 50589 2nd portion and

are shown edged in red and marked “A”, “B” and “C” on plan

P.D. 168_88_15, as follows

(a) Plots 68 to 76 are registered with the

Government as Tenements bearing numbers X02575,

X02577, X04427, X02578, X03962, X04175, X00703 and

X00722 and they are bounded on the West by Triq l-

Alwiża, on the East by Triq l-Ispika and on the South by

property of the Housing Authority or its successors in title;

(b) Plots 89 to 94 are registered with the

Government as Tenements bearing numbers X06457 to

X06461 and X06521 and they are bounded on the South-

West by Triq ir-Raddiena, on the South-East by Triq

Andrea Deguara and on the North-West by Triq il-Fdal

Puniku; and

(c) Plots 106 and 107 are registered with the

Government as Tenements bearing numbers X06532 and

X06533 and Plots 111 and 112 are registered with the

Government as Tenements bearing numbers X06535 and

X06536 and they are bounded on the South-West by Triq

il-Banijiet Rumani, on the North-East by Triq il-Fdal

Puniku and on the North-West by property of the Housing

Authority or its successors in title. (HAM 911/88).

(13) Two houses, known as House 44 and House 64

(now 6) in Triq il-Mitħna and Triq it-Trinċetta, Mosta and these

houses fall on Government property formerly part of Tenement

No. 84038 and are shown edged in red and marked “House 44”

and “6 (Formerly 64)” on plan HA 692/2015, as follows

(a) House 44 is registered with the Government

as Tenement No. 70736 and is bounded on the West by

Triq il-Mitħna, and on the North and on the South by

property of the Government or its successors in title; and

(b) House 64 is registered with the Government

as Tenement No. 70756 and is bounded on the East by a

public passage, on the South by a public open space and on

the North by Triq it-Trincetta. (HAA 50/2015).

(14) A block consisting of six flats that are registered

with the Government as Tenements bearing numbers 64982 to

64987 in Old Government Building in Triq il-Kunċizzjoni

Msida. This block is bounded on the South-East by Triq M A

Vassalli, on the North-West by private property and on the

South-West by Triq il-Kunċizzjoni. This block falls on

Government property acquired by Deed No. 33/62 dated 10th

March 1962 and by Deed No. 105 dated 5th May 1962 in the

acts of Notary A. Attard and by Deed No. 58/86 dated 26th

March 1986 in the acts of Notary F. Portelli and is shown edged

in red on plan P.D. 88_98_2. (HAA 132/2014).

(15) Three plots of land, known as Plots 144 to 146,

Plots 301 to 304 and Plots 313 to 336 in Triq it-Tuffieħ, Triq

Korfu, Triq il-Marokk, Triq Ġibiltà and Triq Ċipru, Naxxar.

These plots fall on Government property acquired by Deed No.

199/92 dated 21st July 1992, by Deed No. 326/93 dated 15th

December 1993, by Deed No. 9/94 dated 26th January 1994 and

by Deed No. 149/94 dated 6th July 1994 all in the acts of Notary

V. Miceli, by Schedule of Deposit No. 178/2003 dated 3rd

February 2003, by President’s Declaration No. 71 dated 23rd

January 2012, by President’s Declaration No. 844 dated 21st

August 2014, as part of Tenement No. 51170, as part of

Tenement No. 51410 and as part of wasteland and are shown

edged in red and marked “A”, “B” and “C” on plan P.D.

2012_469_3, as follows

(a) Plots 144 to 146 are registered with the

Government as Tenements bearing numbers X02791 to

X02793 and are bounded on the South-West by Triq it-

Tuffieħ, on the South-East by Triq Spanja and on the

North-West by property of the Housing Authority or its

successors in title;

(b) Plots 152 to 166 are registered with the

Government as Tenements bearing numbers X06620 to

X06634 and are bounded on the North-East by Triq il-

Marokk, on the South-East by Triq Ġibiltà and on the

North-West by Triq Spanja; and

(c) Plots 301 to 304 are registered with the

Government as Tenements bearing numbers X07167 to

X07170 and are bounded on the South-West by Triq Cipra,

on the South-East and on the North-West by property of

the Housing Authority or its successors in title. (HAM 854/

88).

(16) A block, known as Block D2, consisting of twelve

flats of which eight are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq id-

Duluri, Pietà. This block is bounded on the North-East and on

the South-East by public passages and on the North-West by

Triq id-Duluri. Flats numbered 1, 3, 6 and 11 are registered with

the Government as Tenements bearing numbers 69798, 69800,

69803 and 69808 respectively. This block falls on Government

property formerly part of Tenement No. 50026 and the whole

block is shown edged in red and marked “D2” on plan P.D.

2015_0557. (HAA 127/2014).

(17) Two blocks, known as Block C and Block D in Triq

is-Sebħ, Qormi and are bounded on the North, on the South and

on the East by public roads. These blocks fall on Government

property acquired by Deed No. 43/86 dated 25th June 1986 and

by Deed No. 98/78 dated 3rd May 1978 both in the acts of

Notary A. Grech and are shown edged in red and marked “Block

C” and “Block D” on plan P.D. 2013_642, as follows

(a) Block C consists of eight flats of which one is

being excluded from the transfer as it was already

transferred by a previous legal notice. Flats numbered 1 to

3 are registered with the Government as Tenements

bearing numbers 69826 to 69828 and flats numbered 5 to 8

are registered with the Government as Tenements bearing

numbers 69830 to 69833; and

(b) Block D consists of eight flats of which one is

being excluded from the transfer as it was already

transferred by a previous legal notice. Flats numbered 1 to

6 are registered with the Government as Tenements

bearing numbers 69834 to 69839 and flat numbered 8 is

registered with the Government as Tenement No. 69841.

(18) A block, known as Block G, Unit 1 consisting of

eight flats of which one is being excluded from the transfer as it

was already transferred by a previous legal notice, in Triq il-

Knisja, Raħal Ġdid.This block is bounded on the North-West by

a public passage, on the South-East by Government property

and on the South-West partly by a public passage and partly by

Government property. Flats numbered 2 to 8 are registered with

the Government as Tenements bearing numbers 62207 to 62213.

The whole block falls on Government property formerly part of

Tenement No. 50989 and is edged in red and marked as “Block

G Unit 1” on plan P.D. 90_81_1. (HAA 134/2014).

(19) A house, known as House 1 (now 37) in Block O,

in Triq in-Naspli, San Ġwann and is registered with the

Government as Tenement No. 67703. This house is bounded on

the North-West and on the South-East by property of the

Housing Authority or its successors in title and on the South-

West by Triq ir-Rummien. This house falls on Government

property acquired by Deed No. 22/73 dated 14th February 1973

and by Deed No. 150 dated 10th April 1974 both in the acts of

Notary A. Grech and is shown edged in red and marked “House

1” on plan HA 788/2015. (HAA 142/2014).

(20) A block, known as Block 8, consisting of twenty-

three flats of which nine are being excluded from the transfer as

they were already transferred by a previous legal notice and

excluding the subsoil, in Triq il-Ballut, San Gwann. This block

is bounded on the North by Triq il-Ġewża, on the East by Triq

iż-Żebbuġ and on the South by Triq il-Ballut. Flats numbered 5

to 8 Entrance A are registered with the Government as

Tenements bearing numbers 68964 to 68967, flats numbered 9

and 10 Entrance B are registered with the Government as

Tenements bearing numbers 68968 and 68969 respectively, flats

numbered 13 to 16 Entrance B are registered with the

Government as Tenements bearing numbers 68972 to 68975,

flats numbered 17 to 19 Entrance C are registered with the

Government as Tenements 68976 to 68978, flats numbered 21

and 22 Entrance C are registered with the Government as

Tenements bearing numbers 68980 and 68981 respectively, flat

numbered 24 Entrance C is registered with the Government as

Tenement No. 68983, flats numbered 25 to 29 Entrance D are

registered with the Government as Tenements bearing numbers

68984 to 68988, flats numbered 31 and 32 Entrance D are

registered with the Government as Tenements bearing numbers

68990 and 68991 respectively. This block falls on Government

property acquired by Deed No. 197/75/G dated 18th June 1975,

by Deed No. 169/75 dated 28th May 1975 and by Deed No. 163/

66 dated 18th June 1966 all in the acts of Notary A. Grech and

by Schedule of Deposit No. 268 dated 20th March 2001 and the

whole block is shown edged in red and marked “Block 8” on

plan P.D. 2013_709_A. (HAA 85 - 88/2013).

(21) A house, known as House 4 in Block J, Triq in-

Naspli, San Ġwann and is registered with the Government as

Tenement No. 67340. This house is bounded on the North and

on the South by Government property and on the West by Vjal

in-Naspli. This house falls on Government property acquired by

President’s Declaration No. 722 dated 5th July 2007 and is

shown edged in red and marked “House 4” on plan HA 787/

2015. (HAA 142/2014).

(22) A block, known as Block D2, consisting of eight

flats of which four are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq id-

Deffa, Ta’ Xbiex. This block is bounded on the North by a

public open space, on the East by Triq il-Maskli and on the West

by Triq il-Kosbor. Flats numbered 1 and 2 are registered with

the Government as Tenements bearing numbers 69240 and

69241 respectively, and flats numbered 5 and 6 are registered

with the Government as Tenements bearing numbers 69244 and

69245 respectively. This block falls on Government property

acquired by Deed No. 193/77/G dated 21st September 1977 and

by Deed No. 52/78/G dated 15th March 1978 both in the acts of

Notary A. Grech and the whole block is shown edged in red and

marked “Block D2” on plan P.D. 175_81_24. (HAA 224/2012).

(23) Ten houses, known as House 1 and Houses 3 to 9 in

Triq San Leonardu, Żabbar and these houses fall on

Government property formerly part of ex-Services Tenement

No. 16268 on plan HA 884/2015, as follows

(a) House 1 is registered with the Government as

Tenement No. 70371 and is bounded on the North-East by

Triq San Leonardu, on the South-West by Triq il-Werżieq

and on the North-West by a public road; and

(b) Houses 3 to 9 are registered with the

Government as Tenements bearing numbers 70373 to

70379 and are bounded on the North-East by Triq San

Leonardu, on the South-West by Triq il-Werżieq and on the

North-West by property of the Housing Authority or its

successors in title. (HAA 141/2014).

(24) A house, known as House 25 (now 9) in Triq

Ferdinando Falzon, Żurrieq and is registered with the

Government as Tenement No. 67642. This house is bounded on

the North and on the South by property of the Housing

Authority or its successors in title and on the West by Triq

Ferdinandu Falzon. This house falls on Government property

acquired by Deed No. 271/77 dated 21st December 1977 and by

Deed No. 196/71 dated 21st December 1971 both in the acts of

Notary A. Grech and is shown edged in red and marked “House

9” on plan HA 824/2015. (HAA 59/2015).

(25) Three houses, known as Houses 1, 4 and 5 in Triq

it-Tabib Anton Tabone in Taċ-Ċawla, Rabat, Għawdex and they

fall on Government property formerly part of Tenement No.

Z50286 and are shown edged in red and marked “1”, “4” and

“5” on plan HA 1022/2014, as follows

(a) House 1 is registered with the Government as

Tenement No. Z60291 and is bounded on the North-West

by Government property, on the North-East by Triq it-

Tabib Anton Tabone and on the South-East by property of

the Housing Authority or its successors in title; and

(b) House 4 and House 5 are registered with the

Government as Tenements bearing numbers Z60294 and

Z60295 respectively and are bounded on the North-West

and on the South-East by property of the Housing

Authority or its successors in title and on the North-East by

Triq it-Tabib Anton Tabone. (HAA 2/2015).
