MERCHANT SHIPPING ACT

(CAP. 234)

Merchant Shipping (Fees) (Amendment) Regulations, 2015

IN exercise of the powers conferred by article 374 of the

Merchant Shipping Act, the Minister for Transport and Infrastructure

has made the following regulations

(1) The title of these regulations is the Merchant Citation and

Shipping (Fees) (Amendment) Regulations, 2015 and these commencement.

regulations shall be read and construed as one with the Merchant

Shipping Fees Regulations, hereinafter referred to as "the principal

regulations".

(2) These regulations shall come into force on the 1st August,

2015

Provided that the fee payable in respect of any item

provided for in the principal regulations, both before and after the

coming into force of these regulations, shall be that applicable on the

day the certificate was issued or the service was given irrespective of

when such fees are being paid.

Part 1 of the Schedule to the principal regulations shall be Amends Part 1

of the Schedule

amended as follows

to the principal

regulations.

(a) immediately after the item "Registration of mortgage or

special privilege on a registered ship .... 500" there shall be added

the following item

"Registration of a mandate or power of

attorney (including the registration of any

notice of cancellation or release thereof) in

terms of article 17 of the Merchant Shipping

Act ...................................................................

100";

(b) for the item "Issue of certificate of insurance or other

financial security in respect of either civil liability for oil pollution

damage or civil liability for bunker oil pollution damage in respect

of a ship registered in Malta .... 100" there shall be substituted the

following

"Issue of certificate of insurance or other

financial security in respect of civil liability

for oil pollution damage, civil liability for

bunker oil pollution damage, liability for the

death of and personal injury to passengers or

liability for the removal of wrecks in respect of

a ship registered in Malta .................................

(c) for the item "Issue of certificate of

insurance or other financial security in respect of

either civil liability for oil pollution damage or civil

liability for bunker oil pollution damage in respect of

a ship not registered in Malta.... 200" there shall be

substituted the following

"Issue of certificate of insurance or other

financial security in respect of civil liability

for oil pollution damage, civil liability for

bunker oil pollution damage, liability for the

death of and personal injury to passengers or

liability for the removal of wrecks in respect of

a ship not registered in Malta ..........................

(d) immediately after the item "Issue of safe

manning certificate .... 100", there shall be added the

following items

"Issue of a Declaration of Maritime Labour

Compliance .....................................................

Issue of a Certificate of Compliance in terms

of the Commercial Yacht Code ........................

Part 2 of the Schedule to the principal regulations shall be

amended as follows

(a) the words "the Merchant Shipping (A.B. and E.D.H

Certificates) Regulations, and" shall be deleted;

(b) for the item "Approval of Training Institute to provide

courses in terms of the certification regulations .... 3000" there shall

be substituted the following

"Approval of Maritime Training Centre to

provide courses in terms of the certification

regulations; and

Approval as Designated Auditor to monitor

Maritime Training Centres ...............................

(c) immediately after the item "Approval of courses leading

to the issue of certificates in terms of the certification regulations ....

2000" there shall be added the following item

"Renewal of approval of Maritime Training

Centre, renewal of approval of maritime

training courses and renewal of approval as

50% of
