Housing Authority (Transfer of Assets) (No. 3) Order, 2015

IN exercise of the powers conferred by article 12 of the Housing

Authority Act, the President of Malta has made the following order:-

The title of this order is the Housing Authority (Transfer of

Assets) (No. 3) Order, 2015.

The property described in article 4 of this order is hereby

specified for the purpose of article 12 of the Housing Authority Act.

The property specified in article 2 of this order shall be

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 18th of May, 2015.

The property referred to in article 2 of this order is the

following, that is to say

A block, known as Block B, consisting of nine

flats, of which one is being excluded from the transfer as it was

already transferred by a previous legal notice, in Triq Fuq tal-

Ħawli, Birgu. This block is bounded on the North-East by Triq

San Dwardu, on the North-West by Triq Fuq tal-Ħawli and on

the South-West by a public road. Flat numbered 1 is registered

with the Government as Tenement No. 69174 and flats

numbered 3 to 9 are registered with the Government as

Tenements bearing numbers 69176 to 69182. This block falls on

Government property formerly part of Tenement No. 51054 and

the whole block is edged in red and marked “Block B” on plan

P.D. 78_80_22. (HAA 10/2015).

A block, known as Block A3, consisting of six flats

which are registered with the Government as Tenements bearing

numbers 72809 to 72814, in Triq Mater Boni Consiglii, Fgura.

This block is bounded on the North-East and on the North-West

by an open space and on the South-West in part by Triq Mater

Boni Consiglii and in part by Government property and falls on

Government property acquired by Deed No. 229/95 dated 19th

September 1995 in the acts of Notary V. Miceli, by Deed No.

59/80 dated 9th April 1980 in the acts of Notary A. Grech and

by President’s Declaration No. 1014/2003. The whole block is

edged in red and marked “Block A3” on plan P.D. No.

151_83_8. (HAA12/2014).

Three blocks, known as Blocks F, G and H at tar-

Rabbat, Hamrun and these blocks are bounded on the North-

East, on the South-East and on the South-West by Government

property. These blocks fall on Government property acquired by

Deed No. 10/95 dated the 1st of February 1995 in the acts of

Notary V. Miceli and by President’s Declaration No. 116 dated

3rd February 2005 and is shown edged in red and marked

“Block F”, “Block G” and “Block H” on plan P.D. 95_81_21 as

follows

(a) Block F consists of eight flats, of which one

is being excluded from the transfer as it was already

transferred by a previous legal notice. Flats numbered 1 to

4 are registered with the Government as Tenements

bearing numbers 66855 to 66858 and flats numbered 6 to 8

are registered with the Government as Tenements bearing

numbers 66860 to 66862;

(b) Block G consists of four flats, of which one is

being excluded from the transfer as it was already

transferred by a previous legal notice. Flats numbered 1

and 2 are registered with the Government as Tenements

bearing numbers 67229 and 67230 respectively and flat

numbered 4 is registered with the Government as

Tenement No. 67232; and

(c) Block H consists of eight flats registered with

the Government as Tenements bearing numbers 66863 to

66870. (HAA166/2014, HAA 215/2013, HAA 216/2013).

A block, known as Block 8, consisting of four

dwellings registered with the Government as Tenements bearing

numbers 63560 to 63563, in Triq il-Miġja tal-Papa and Triq Dun

Karm Azzopardi, Isla. This block is bounded on the North-West

by Triq il-Kunċizzjoni, on the South-West by Triq Dun Karm

Azzopardi and on the North-East by Triq il-Miġja tal-Papa. The

whole block falls on Government property acquired by

President’s Declaration No. 65 dated 23rd January 2012 and is

shown edged in red on plan P.D. 2015_0377. (HAA 9/2015).

A block, known as Block A3, consisting of six

flats, of which four are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq il-

Gżari, Mosta. This block is bounded on the West by Triq il-

Gżari, on the North by Triq it-Trinċetta and on the South by a

public passage. Flats numbered 3 and 4 are registered with the

Government as Tenements bearing numbers 70778 and 70779

respectively. The whole block falls on Government property

acquired by Deed No. 6/75 and by Deed No. 7/75 both dated

15th January 1975 in the acts of Notary A. Grech and is shown

edged in red and marked “Block A3” on plan P.D. 203_80_21.

A block, known as Block F3, consisting of six flats,

of which three are being excluded from the transfer as they were

already transferred by a previous legal notice, in Triq in-Nasba,

Mosta. This block is bounded on the North-East by Triq it-

Trinċetta, on the North-West by Triq in-Nasba and on the South-

East by a public passage. Flat numbered 1 is registered with the

Government as Tenement No. 71492 and flats numbered 5 and 6

are registered with the Government as Tenements bearing

numbers 71496 and 71497 respectively. This block falls on

Government property acquired by Deed No. 7/75 dated 15th

January 1975 in the acts of Notary A. Grech and the whole

block is shown edged in red and marked “Block F3” on plan

P.D. 203_80_20. (HAA 131/2014).

A block, known as Block A, Sections 1 and 2

consisting of eighteen flats, of which six are being excluded

from the transfer as they were already transferred by a previous

legal notice, in Ħal Dmikki Housing Estate, Għaxaq. The block

is bounded on the West by Triq il-Miksur, on the North by Triq

id-Dejl and on the South by a public passage. Flats numbered 1

and 3 are registered with the Government as Tenements bearing

numbers 69434 and 69436 respectively, flats numbered 6 to 8

are registered with the Government as Tenements bearing

numbers 69439 to 69441, flats numbered 10 and 11 are

registered with the Government as Tenements bearing numbers

69443 and 69444 respectively, flats numbered 13 to 16 are

registered with the Government as Tenements bearing numbers

69446 to 69449, and flat numbered 18 is registered with the

Government as Tenement No. 69451. This block falls on

Government property acquired by Deed No. 175/79/G dated

15th September 1979 in the acts of Notary A. Grech and the

whole block is shown edged in red and marked “Block A” on

plan P.D. 66_78_11. (HAA 68/2014, HAA 69/2014).

A block, known as Block C, Sections 1 and 2

consisting of eighteen flats of which eight are being excluded

from the transfer as they were already transferred by a previous

legal notice, in Ħal Dmikki Housing Estate, Għaxaq. This block

is bounded on the West by a public open space, on the North by

Triq id-Dejl and on the South by Triq ir-Rebbiegħa. Flats

numbered 2 and 3 are registered with the Government as

Tenements bearing numbers 69472 and 69473 respectively, flats

numbered 5 to 9 are registered with the Government as

Tenements bearing numbers 69475 to 69479, flats numbered 11

and 12 are registered with the Government as Tenements

bearing numbers 69481 and 69482 respectively and flat

numbered 18 is registered with the Government as Tenement

No. 69488. This block falls on Government property acquired

by Deed No. 175/79/G dated 15th September 1979 in the acts of

Notary A. Grech and the whole block is shown edged in red and

marked “Block C” on plan P.D. 2015_0203. (HAA 70/2014,

HAA 200/2013).

A block, known as Block 5, Entrances A, B and D,

in Misraħ Lewża, San Ġwann and falls on Government property

acquired by Deed No. 209 dated 10th September, 1962 in the

acts of Notary A. Grech and the whole block is edged in red on

plan P.D. 2011_873_1, as follows

(a) Entrance A consists of eight flats, of which

three are being excluded from the transfer as they were

already transferred by a previous legal notice, and is

bounded on the North-East by Triq ir-Rihan, on the South-

West by Misraħ Lewża and on the South-East by Triq Feliċ

Borg. Flats numbered 1, 3 and 5 are registered with the

Government as Tenements bearing numbers 66254, 66256

and 66258 respectively and flats numbered 7 and 8 are

registered with the Government as Tenements bearing

numbers 66260 and 66261 respectively;

(b) Entrance B consists of eight flats and a

washroom and is bounded on the North-East by Triq ir-

Rihan, on the North-West by property of the Housing

Authority or its successors in title and on the South-West

by Misraħ Lewża. Flats numbered 1 to 8 are registered

with the Government as Tenements bearing numbers

66262 to 66269 and the washroom is registered as

Tenement No. E20397; and

(c) Entrance D consists of eight flats and two

sites, of which three flats and one site are being excluded

from the transfer as they were already transferred by a

previous legal notice, and is bounded on the East by Triq

il-Ġibjun, on the North-East by property of the Housing

Authority or its successors in title and on the South-East by

Misraħ Lewża. Flats numbered 2 and 4 are registered with

the Government as Tenements numbered 66279 and 66281

respectively, flats numbered 6 to 8 are registered with the

Government as Tenements bearing numbers 66283 to

66285 and Site C is registered with the Government as

Tenement No. 52046. (HAA 77/2013 HAA 78/2012, HAA

157/2011).

(10) A block, known as Block Q consisting of six flats,

of which three flats are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq l-

Anzalor, Santa Luċija. This block is bounded on the South-East

by Triq il-Fuxa, on the North-West by Government property and

on the South-West by Triq l-Anzalor. Flats numbered 2 and 3

are registered with the Government as Tenements bearing

numbers 70871 and 70872 respectively and flat numbered 6 is

registered with the Government as Tenement No. 70875. This

block falls on Government property acquired by Deed No. 87/

77 dated 16th August 1977 and by Deed No. 86/74 dated 16th

August 1977, both in the acts of Notary A. Attard and the whole

block is edged in red and marked “Block Q” on plan P.D.

(11) A block, known as Block S consisting of six flats,

of which one is being excluded from the transfer as it was

already transferred by a previous legal notice, in Triq Katerina

Vitale, Santa Luċija. This block is bounded on the North-West

by Triq Katerina Vitale, on the South-East and on the North-

East by public passages. Flat numbered 1 is registered with the

Government as Tenement No. 70876 and flats numbered 3 to 6

are registered with the Government as Tenements bearing

numbers 70878 to 70881. This block falls on Government

property acquired by Deed No. 87/77 dated 16th August 1977

and by Deed No. 556/74 dated 16th August 1974, both in the

acts of Notary A. Attard and the whole block is edged in red and

marked “Block S” on plan 11_82_123. (HAA 38/2014).

(12) House numbered 17, Triq il-Werżieq, Żabbar

(Tenement No. 70837 - HAA 141/2014).

(13) Three blocks, known as Blocks C1, C2 and C3 in

Triq Ġanni Bonnici, Triq Dun Luret Callus and Triq Dun Nerik

Sant, Żebbuġ and these blocks fall on Government property

acquired by Deed No. 276/96 dated 18th December 1996 in the

acts of Notary V. Miceli and are shown edged in red and marked

“Block C1”, “Block C2” and “Block C3” on plan P.D. 2014_72,

as follows

(a) Block C1 consists of six flats registered with

the Government as Tenements bearing numbers 73480 to

73485 and is bounded on the North-West and on the South-

East by Government property and on the South-West in

part by Government property and in part by a public

passage off Triq Ġanni Bonnici;

(b) Block C2 consists of six flats registered with

the Government as Tenements bearing numbers 73486 to

73491 and is bounded on the South-East by a public

passage, on the North-West by Triq Ġanni Bonnici and on

the North-East by Triq Dun Luret Callus; and

(c) Block C3 consists of six flats, of which one is

being excluded from the transfer as it was already

transferred by a previous legal notice. This block is

bounded on the North-West and on the South-East by

Government property and on the North-East in part by

Government property and in part by a public passage off

Triq Nerik Sant. Flats numbered 1 to 5 are registered with

the Government as Tenements bearing numbers 73492 to

73496. (HAA 70/2013, HAA 145/2013, HAA 146/2013).

(14) Two blocks, known as Blocks A and B consisting

of twelve flats, of which two are being excluded from the

transfer as they were already transferred by a previous legal

notice, in Triq Xandru D’Amato, Żurrieq. These blocks are

bounded on the North-East by Triq Xandru D’Amato and on the

South-West and on the North-West by public passages. Flats

numbered 2 and 3 in Block A are registered with the

Government as Tenements bearing numbers 70354 and 70355

respectively, flats numbered 5 and 6 in Block A are registered

with the Government as Tenements bearing numbers 70357 and

70358 and flats numbered 7 to 12 in Block B are registered with

the Government as Tenements bearing numbers 70359 to 70364.

These blocks fall on Government property formerly part of

Tenement No. 50813 and is shown edged in red and marked

“Block A” and “Block B” on plan P.D. 67_93_7. (HAA136/

2014, HAA138/2014).

(15) Two blocks, known as Blocks C and D consisting

of twelve flats, of which one is being excluded from the transfer

as it was already transferred by a previous legal notice, in Triq

Xandru D’Amato, Żurrieq. These blocks are bounded on the

South-West by Triq Wied Babu and on the North-East and on

the North-West by public passages. Flats numbered 1 to 3 in

Block C are registered with the Government as Tenements

bearing numbers 69422 to 69424, flats numbered 5 and 6 in

Block C are registered with the Government as Tenements

bearing numbers 69426 and 69427 respectively and flats

numbered 7 to 12 in Block D are registered with the

Government as Tenements bearing numbers 69428 to 69433.

These blocks fall on Government property formerly part of

Tenement No. 50813 and is shown edged in red and marked

“Block C” and “Block D” on plan P.D. 67_93_8. (HAA 137/

2014, HAA 139/2014).

(16) A block, known as Block D consisting of eight flats

registered with the Government as Tenements bearing numbers

Z60331 to Z60338 in Triq iċ-Ċawla, Rabat, Gozo. This block is

bounded on all sides by public passages and falls on

Government property formerly registered as part of Tenement

No. 80040 and the whole block is shown edged in red and

marked “Block D” on plan P.D. 2014_886. (HAA 10/2013).

(17) A block, known as Block IA consisting of eight

flats, of which one is being excluded from the transfer as it was

already transferred by a previous legal notice, in Triq iċ-Ċawla,

Rabat, Gozo. This block is bounded on the South and on the

West by a public road and on the North by a public passage.

Flats numbered 1 to 7 are registered with the Government as

Tenements bearing numbers Z60551 to Z60557. This blocks

falls on Government property formerly registered as part of

Tenement No. 80038 and the whole block is shown edged in red

and marked “Block IA” on plan P.D. 203_85_10. (HAA 129/

2014).
