AUTHORITY FOR TRANSPORT IN MALTA ACT

(CAP. 499)

Low-Powered Vehicles and Pedal Cycles

(Amendment) Regulations, 2015

IN exercise of the powers conferred by article 54 of the Traffic

Regulation Ordinance and article 43 of the Authority for Transport in

Malta Act, the Minister for Transport and Infrastructure has, after

consultation with the Authority for Transport in Malta, made the

following regulations

The title of these regulations is the Low-Powered Vehicles

and Pedal Cycles (Amendment) Regulations, 2015, and they shall be

read and construed as one with the Low-Powered Vehicles and Pedal

Cycles Regulations, 2004, hereinafter referred to as “the principal

regulations”.

Regulation 2 of the principal regulations shall be amended

as follows

(a)

in the definition "low-powered cycle", the words

"or by a motor of a piston displacement" shall be substituted by

the words "or by a combustion engine of a piston displacement"

and immediately after the words "two brake horsepower," there

shall be inserted the words "or an electric motor with a

maximum net power output of 1.49Kw,";

(b)

the definition "power assisted pedal cycle" shall be

substituted by the following

" "power assisted pedal cycle" means a two or

three-wheeled motor assisted cycle, including pedelecs,

having a kerbside weight of not more than 40 kilogrammes

in the case of a bicycle and not more than 60 kilogrammes

in the case of a tricycle or tandem bicycle, and is fitted

with pedals capable of propelling it;".

For the words “PEDAL CYCLES AND POWER

ASSISTED PEDAL CYCLES” in the title of Part I of the principal

regulations there shall be substituted the words “PEDAL CYCLES,

POWER ASSISTED PEDAL CYCLES AND PEDELECS”.

Regulation 3 of the principal regulations shall be amended Amends

regulation 3 of

as follows

the principal

regulations.

(a) in sub-regulation (1) thereof immediately after the words

"No pedal cycle" there shall be inserted the words "manufactured for

the purpose of being used as a pedal cycle";

(b) in sub-regulation (2) thereof immediately after the words

"a pedal cycle" there shall be inserted the words "manufactured for

the purpose of being used as a pedal cycle"; and

(c) in sub-regulation (3) thereof immediately after the words

"a pedal cycle" there shall be inserted the words "manufactured for

the purpose of being used as a pedal cycle" and the words "sub-

regulations (1) and (2)" shall be substituted by the words "sub-

regulation(1)".

Regulation 4 of the principal regulations shall be amended Amends

regulation 4 of

as follows

the principal

regulations.

(a)

sub-regulation (2) thereof shall be substituted by the

following

"(2) The registration of power assisted pedal cycles,

including pedelecs, whose electric motor has an output of more

than 250 watts shall be made against the payment of an

administrative fee of eleven euros and sixty-five cents (€11.65)

payable to the Authority.";

(b) sub-regulation (3) thereof shall be renumbered as sub-

regulation (4);

(c) immediately after sub-regulation (2) thereof there shall be

inserted the following new sub-regulation

"(3) No administrative fee shall be charged for the

registration of power assisted pedal cycles, including pedelecs,

whose electric motor has an output of not more than 250

watts."; and

(d)

paragraphs (a) and (b) of sub-regulation (4)

thereof, as renumbered, shall be substituted by the following

"(a)

registration form duly filled and stamped by the

Customs Department if imported from a State which is not a

Member State of the European Union,

(b)

customs documents if imported from a State which

is not a Member State of the European Union,".

Immediately after regulation 4 of the principal regulations

there shall be added the following new regulation 4A

4A. No power assisted pedal cycle, including

"Third party risks

insurance.

pedelecs, whose electric motor has an output of more

than 250 watts may be used on the road unless it is

covered by a third-party risks insurance in compliance

with the requirements of the Motor Vehicle Insurance

(Third-Party Risks) Ordinance.".

Sub-regulation (1) of regulation 5 of the principal

regulations shall be substituted by the following

"(1) No person shall ride a power assisted pedal cycle,

including a pedelec, on a road unless that person -

(a)

has reached the age of sixteen years,

(b)

is in possession of a legally valid identification

document, and

(c)

where such person is to ride a power assisted pedal

cycle, including a pedelec, whose electric motor has an output

of more than 250 watts, has satisfied the Authority that he or she

has some knowledge of the Highway Code through a theory

test.".

Paragraph (a) of regulation 6 of the principal regulations

shall be amended as follows

(a) in sub-paragraph (ii) thereof, the words "of an electric

motor; and" shall be substituted by the words "of an electric motor;";

(b) sub-paragraph (iii) thereof shall be substituted by the

following

"(iii) the cubic capacity and horse power of the motor of

the internal combustion; and"; and

(c) immediately after sub-paragraph (iii) thereof, there shall be

added the following new sub-paragraph

"(iv) the continuous rated output in Kw of the electric

motor;".

In regulation 7 of the principal regulations, the words Amends

"power assisted pedal cycle" shall be substituted by the words "power regulation

(b) in sub-regulation (2) thereof, the words "When riding a

pedal cycle or a power assisted pedal cycle" shall be substituted by

the words "When riding a pedal cycle or a power assisted pedal cycle,

including a pedelec", and immediately after the words "to an

intersection" there shall be added the words "or a roundabout or when

overtaking other traffic".

In regulation 12 of the principal regulations, the words Amends

"any pedal cycle or a power assisted pedal cycle" shall be substituted regulation

Regulation 13 of the principal regulations shall be Amends

In regulation 14 of the principal regulations, the words "or

a power assisted pedal cycle" shall be substituted by the words "or a

power assisted pedal cycle, including a pedelec".

Regulation 15 of the principal regulations shall be

amended as follows

(a) in sub-regulation (1) thereof, the words "pedal cycles"

shall be substituted by the words "pedal cycles or power assisted

pedal cycles, including pedelecs or between any of such cycles ";

(b)

in sub-regulation (2) thereof, the words "pedal cycle

races" shall be substituted by the words "races between pedal cycles

or between power assisted pedal cycles or between pedelecs or

between any of such cycles".
