Liquefied Petroleum Gas Market (Amendment)

Regulations, 2015

IN exercise of the powers conferred by sub-article (1) of article

28 of the Malta Resources Authority Act, the Minister for Energy and

Health, after consultation with the Malta Resources Authority, has

made the following regulations:-

The title of these regulations is the Liquefied Petroleum Citation.

Gas Market (Amendment) Regulations, 2015, and these regulations

shall be read and construed as one with the Liquefied Petroleum Gas S.L. 423.31

Market Regulations, hereinafter referred to as "the principal

regulations".

In regulation 2 of the principal regulations immediately Amends

after the definition "bulk LPG distributor vehicle" there shall be regulation

" "competent LPG installer" means a person who is

approved by the Authority and who is suitably trained, has

sufficient knowledge, experience and capability as approved by

the Authority to

(a) construct equipment and, or sites intended to

be designated by the Authority as authorised facilities; and

(b) carry out material alterations to authorised

facilities; and

(c) carry out other work of a technical nature that

is complimentary or ancillary to the above;".

In sub-regulation (3) of regulation 6 of the principal Amends

regulations, immediately after the words "by a competent person" regulation

Regulation 15 of the principal regulations shall be Amends

constructed";

(b)

abided to and including a signed declaration to the effect that

such authorised facilities have been constructed by a competent

LPG installer."; and

(c)

immediately after sub-regulation (2) thereof there

shall be added the following new sub-regulation

"(3) No person other than a competent LPG

installer, shall construct an authorised facility or a facility

required to be so authorised or carry out any material

alteration to an authorised facility under these regulations

Provided that such competent LPG installer shall

be supervised by a competent person in the construction of

an authorised facility or a facility required to be so

authorised under these regulations.".

Regulation 16 of the principal regulations shall be

amended as follows

(a)

sub-regulation (3) thereof shall be substituted by

the following new sub-regulation

"(3) No person, other than a competent person,

shall supervise any material alteration carried out on an

authorised facility.";

(b)

in sub-regulation (4) thereof, for the word

"conducting" there shall be substituted the word "supervised";

(c)

sub-regulation (5) thereof shall be substituted by

the following new sub-regulation

"(5) Once the material alterations have been

carried out, the competent person commissioned by the

authorised person to supervise the material alterations and

the competent LPG installer commissioned by the

authorised person to perform such alterations must submit

in writing a certification that all safety requirements

imposed on the authorised facility have been complied

with."; and

(d)

immediately after sub-regulation (6) thereof there

shall be added the following new sub-regulation

"(7) No person other than a competent LPG

installer, shall construct or carry out any material alteration

on an authorised facility or a facility required to be so

authorised

Provided that such competent LPG installer shall

be supervised by a competent person in the construction of

and the carrying out of any material alteration on an

authorised facility or a facility required to be so

authorised.".

In the First Schedule to the principal regulations, for the Amends the

words "The applicable fee for applying for an authorisation for First

(i) for a fixed piped network with 2 metered

outlets - €50.00;

(iii) for a fixed piped network with a number of

metered outlets between 6 and 10 - €200.00;

(iv) for a fixed piped network with a number of

metered outlets between 11 and 15 - €300.00;

(v) for a fixed piped network with over 15

metered outlets - €500.00.".

In the Second Schedule to the principal regulations, for the Amends the

words "The applicable authorisation fee for operating a fixed piped Second

piped network shall be as follows

(i) for a fixed piped network with 2 metered

outlets - €50.00;

(ii) for a fixed piped network with a number of

(iii) for a fixed piped network with a number of

metered outlets between 6 and 10 - €200.00;

(iv) for a fixed piped network with a number of

metered outlets between 11 and 15 - €300.00;

(v) for a fixed piped network with over 15

metered outlets - €500.00.".

In the Third Schedule to the principal regulations

immediately after the figure "€35" there shall be added the following

"Fee due to the Authority for approval as a competent LPG

installer ........................... €35".
