Arbitration (Amendment) Rules (Amendment) Rules, 2015

IN exercise of the powers conferred by paragraph (ii) of sub-

article (1) of article 10 of the Arbitration Act, the Malta Arbitration

Centre, with the concurrence of the Minister for Justice, Culture and

Local Government and the Minister for Finance, has made the

following rules:-

The title of these rules is the Arbitration (Amendment) Citation.

Rules (Amendment) Rules, 2015, and these rules shall be read and

construed as one with the Arbitration (Amendment) Rules, L.N. 57 of 2015.

promulgated by means of Legal Notice 57 of 2015, hereinafter

referred to as "the principal rules".

Rule 1 of the principal rules shall be amended as follows

Amends rule 1

of the principal

rules.

(a)

the present provision shall be re-numbered as sub-

rule (1) thereof; and

(b)

immediately after sub-rule (1) of rule 1, as re-

numbered, of the principal rules there shall be added the

following new sub-rule

"(2) The provisions of these rules shall come into

force on 1st May, 2015.".

Rule 2 of the principal rules shall be amended as follows

Amends rule 2

of the principal

rules.

(a)

in the first paragraph of paragraph 3 of Part II of

Appendix A of the Arbitration Rules, as substituted by rule 2 of

the principal rules, for the words "In the case of mandatory

arbitrations, the arbitral tribunal’s fees" there shall be

substituted the words "In the case of mandatory arbitrations

filed on or after the coming into force of these rules, the arbitral

tribunal’s fees"; and

(b)

in the second proviso to paragraph 3 of Part II of

Appendix A of the Arbitration Rules, as substituted by rule 2 of

the principal rules, for the words "No charge shall be levied if

more than six sittings are held:" there shall be substituted the

words "No charge shall be levied if more than three sittings are

held:".

(1)

Legal Notice 145 of 2015 is hereby revoked.

(2) The provisions of sub-rule (1) of this rule shall be deemed

to have come into force on the 4th of May, 2015, and the provisions

of the said Legal Notice 145 of 2015 shall be deemed as never having

come into force prior to the publication of this Legal Notice.
