Housing Authority (Transfer of Assets) (No. 5) Order, 2014

IN exercise of the powers conferred by article 12 of the Housing

Authority Act, the President of Malta has made the following order:-

The title of this order is the Housing Authority (Transfer of

Assets) (No. 5) Order, 2014.

The property described in article 4 of this order is hereby

specified for the purpose of article 12 of the Housing Authority Act.

The property specified in article 2 of this order shall be

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 2nd of October, 2014.

The property referred to in article 2 of this order is the

following, that is to say

A block, known as Block C, consisting of nine flats

that are registered with the Government as Tenements bearing

numbers 69183 to 69191 and excluding the subsoil at Tal-Ħawli

in Wesgħa Mattia Preti, Birgu. This block is bounded on the

North-East by Triq San Dwardu, on the North-West by Wesgħa

Mattia Preti and on the South-West by Triq il-Kottonera and

falls on Government property formerly part of Tenement No.

51054. The whole block is shown edged in red and marked

“Block C” on plan P.D. 2013_666. (HAA 201/2012).

A block, known as Block F, consisting of eighteen

flats of which two are being excluded from the transfer as they

were already transferred by a previous legal notice, and six

garden sites at Tal-Ħawli in Triq Peppi Vella, Birgu. This block

is bounded on the South-East by Triq Peppi Vella, on the North-

West by an open space and on the South-West by Triq il-Qalb

ta’ Ġesu. Flats numbered 1 to 5, Entrance A are registered with

the Government as Tenements bearing numbers 72686 to 72690,

flats numbered 2 to 6, Entrance B are registered with the

Government as Tenements bearing numbers 72693 to 72697,

flats numbered 1 to 6, Entrance C are registered with the

Government as Tenements bearing numbers 72698 to 72703 and

sites A to F are registered with the Government as Tenements

bearing numbers 52683 to 52688. This block falls on

Government property acquired by Deed No. 185/80 dated 19th

November 1980 and by Deed No. 187/78G dated 9th August

1978, both in the acts of Notary A. Grech and the whole block is

shown edged in red on plan P.D. 2013_667. (HAA 99/2013,

The administration of six flats and four dwellings

in Block 7 in Triq iċ-Ċentinarju tal-Parroċċa, Triq de Opertis,

Triq il-Palazz l-Antik tal-Gvernatur and Triq ta’ Lhud, Birgu.

This block is bounded on the North-East by Triq il-Palazz l-

Antik tal-Gvernatur, on the South-West by Triq iċ-Ċentinarju

tal-Parroċċa and on the North-West by Triq de Opertis. This

block consists of three flats numbered 1 to 3 accessible from a

common entrance in Triq ta’ Lhud registered with the

Government as Tenements bearing numbers 62823 to 62825,

two dwellings accessible from separate entrances in Triq iċ-

Ċentinarju tal-Parroċċa registered with the Government as flats

numbered 4 and 5 bearing Tenement numbers 62826 and 62827,

three flats numbered 6 to 8 accessible from a common entrance

in Triq de Opertis registered with the Government as Tenements

bearing numbers 62828 to 62830 and two dwellings accessible

from separate entrances in Triq il-Palazz Antik tal-Gvernatur

registered with the Government as flats numbered 9 and 10

bearing Tenement numbers 62831 and 62832. The land where

this block is located is in the course of acquisition by the

Government and the whole block is shown edged in red and

marked “Block 7” on plan P.D. 2013_670. (HAA 130/2013,

The administration of six flats and four dwellings

in Block 8 in Triq iċ-Ċentinarju tal-Parroċċa, Triq de Operatis,

Triq il-Palazz l-Antik tal-Gvernatur and Triq il-Madonna ta’

Monserrat, Birgu. This block is bounded on the North-East by

Triq il-Palazz l-Antik tal-Gvernatur, on the South-West by Triq

iċ-Ċentinarju tal-Parroċċa and on the North-West by Triq il-

Madonna ta’ Monserrat. This block consists of three flats

numbered 1 to 3 accessible from a common entrance in Triq de

Operatis registered with the Government as Tenements bearing

numbers 62833 to 62835, two dwellings accessible from

separate entrances in Triq iċ-Ċentinarju tal-Parroċċa registered

with the Government as flats numbered 4 and 5 bearing

Tenement numbers 62836 and 62837, three flats numbered 6 to

8 accessible from a common entrance in Triq il-Madonna ta’

Monserrat registered with the Government as Tenements

bearing numbers 62838 to 62840 and two dwellings accessible

from separate entrances in Triq il-Palazz l-Antik tal-Gvernatur

registered with the Government as flats numbered 9 and 10

bearing Tenement numbers 62841 and 62842. The land where

this block is located is in the course of acquisition by the

Government and the whole block is shown edged in red and

marked “Block 8” on plan P.D. 2013_751. (HAA 129/2013,

A block, known as Block 11 consisting of eight

flats registered with the Government as Tenements bearing

numbers 62363 to 62370 and excluding the subsoil, forming

part of the Hubbard Flats, Government Housing Estate in Triq

Alessandra, Bormla. This block is bounded on the North-West

by Triq Rikkardu Taylor and on the South-West and on the

North-East by a public passage. The land where this block is

located was acquired by the Government from the War

Department by Deed dated 21st March 1931 and the whole

block is shown edged in red and marked “Block 11” on plan

P.D. 2013_712. (HAA 21/2013).

A block, known as Block A5 consisting of six flats

registered with the Government as Tenements bearing numbers

72821 to 72826 in Triq Mahatma Gandhi, Fgura and is bounded

on the South-West and on the South-East by public roads and on

the North-East by Triq Mahatma Gandhi. This block falls on

Government property acquired by Deed No. 73/93 dated 3rd

March 1993 in the acts of Notary V. Miceli and the whole block

is shown edged in red and marked “Block A5” on plan P.D.

2013_695. (HAA 128/2013).

A block, consisting of fourteen flats of which five

flats are being excluded from the transfer as they were already

transferred by a previous legal notice, in Triq Antonio u Maria

Cumbo and Triq l-14 ta’ Diċembru 1945, Fgura. This block is

bounded on the West by Triq il-Karmnu, on the North by Triq

Antonio u Maria Cumbo and on the South by Triq l-14 ta’

Diċembru 1945. Flat numbered 2 is registered with the

Government as Tenement No. 68029, flats numbered 4 and 5 are

registered with the Government as Tenements bearing numbers

68031 and 68032, flats numbered 7 to 10 are registered with the

Government as Tenements bearing numbers 68034 to 68037 and

flats numbered 13 and 14 are registered with the Government as

Tenements bearing numbers 68040 and 68041. This block falls

on Government property formerly part of Tenement No. 83202

and the whole block is shown edged in red on plan P.D.

A block, consisting of twenty-eight flats of which

twelve flats are being excluded from the transfer as they were

already transferred by a previous legal notice, and excluding the

subsoil in Triq il-Kapuċċini and Triq San Franġisk, Floriana.

This block is bounded on the North-East by Triq Pietro Floriani,

on the North-West by Triq San Franġisk and on the South-East

in part by Triq il-Kapuċċini and in part by private property. Flat

numbered 2 at No. 83 in Triq il-Kapuċċini is registered with the

Government as Tenement No. 63733, flats numbered 7 to 10 at

No. 83 in Triq il-Kapuċċini are registered with the Government

as Tenements bearing numbers 63738 to 63741, flats numbered

1 to 3 at No. 84 in Triq San Franġisk are registered with the

Government as Tenements bearing numbers 63752 to 63754,

flats numbered 5 and 7 at No. 84 in Triq San Franġisk are

registered with the Government as Tenements bearing numbers

63733 and 63758 respectively, flat numbered 1 at No. 86 in Triq

San Franġisk is registered with the Government as Tenement

No. 63742, flats numbered 5 to 7 are registered with the

Government as Tenements bearing numbers 63746 to 63748 and

flats numbered 9 and 10 are registered with the Government as

Tenements bearing numbers 63750 and 63751. The whole block

is shown edged in red on plan P.D. 2013_605. (HAA 194/2012,

A block consisting of nineteen maisonettes,

twenty-three garages and a house in Triq il-Kapuċċini, Kalkara

and having an area of approximately 1675.46 square metres.

This block is bounded on the North-East by an open space, on

the South-West by Triq il-Kappuċċini and on the North-West by

a public passage and falls on Government property partly part of

waste land W00063 and partly by property acquired by means

of the Building Development Area Act, 1983 (Act I of 1983).

The whole block is shown edged in red on plan P.D. 2014_439.

(10) A block, known as Block G2 consisting of nine

flats of which three are being excluded from the transfer as they

were already transferred by a previous legal notice, in Triq it-

Trinċetta, Mosta. This block is bounded on the East and on the

North by a public passage and on the South by Triq l-Istiratur.

Flat numbered 1 is registered with the Government as Tenement

No. 72349, flat numbered 3 is registered with the Government

as Tenement No. 72351, flats numbered 5 to 7 are registered

with the Government as Tenements bearing numbers 72353 to

72355 and flat numbered 9 is registered with the Government as

Tenement No. 72357. This block falls on Government property

acquired by Deed No. 7/75 dated the 15th of January 1975 in the

acts of Notary A. Grech and the whole block is shown edged in

red and marked “Block G2” on plan P.D. 2013_762. (HAA 57/

2013).

(11) A block, known as Block 2 - Binja Ħamrija,

consisting of twenty-five flats and five rooms of which four are

being excluded from the transfer as they were already

transferred by a previous legal notice, in Triq il-Ħamrija,

Naxxar. This block is bounded on the North-East by Triq il-

Ħamrija, on the North-West by Triq Gibiltà and on the South-

West by Triq l-Arġentina. Flats numbered 1 to 5 are registered

with the Government as Tenements bearing numbers 76336 to

76340, flats numbered 8 to 12 are registered with the

Government as Tenements bearing numbers 76343 to 76347,

flats numbered 14 to 16 are registered with the Government as

Tenements bearing numbers 76348 to 76350, flats numbered 18

to 25 are registered with the Government as Tenements bearing

numbers 76352 to 76359 and rooms A to E are registered with

the Government as Tenements bearing numbers 79512 to 79516.

This block falls on Government property acquired by Deed No.

116/74 dated 12th of March 1974, by Deed No. 151/73 dated

24th of August 1973 and by Deed No. 293/74 dated 28th of

August 1974 all in the acts of Notary A. Grech and the whole

block is edged in red and marked “Block 2 - Binja Ħamrija” on

plan P.D. 2013_678. (HAA 122/2013).

(12) A block, known as Block 7, consisting of eight flats

of which three are being excluded from the transfer as they were

already transferred by a previous legal notice, in Triq il-

Fontanier, Qormi. This block is bounded on the North-East by

Government property, on the North-West by Triq il-Fontanier

and on the South-West by Pjazza PP Psaila. Flat numbered 2 is

registered with the Government as Tenement No. 66243 and

flats numbered 5 to 8 are registered with the Government as

Tenements bearing numbers 66246 to 66249. This block falls on

Government property formerly part of Tenement No. 51197 and

the whole block is edged in red and marked “Block 7” on plan

P.D. 2013_641. (HAA 125/2013).

(13) A block, known as Scheme 2, Block 1, Doors A-D,

consisting of twenty-three flats of which three are being

excluded from the transfer as they were already transferred by a

previous legal notice, in Telgħet Raħal Ġdid, Raħal Ġdid. This

block is bounded on the North-East by Telgħet Raħal Ġdid, on

the South-West by a public passage and on the North-West by

Vjal Sir Paul Boffa. Flats numbered 1 to 3, Door A are

registered with the Government as Tenements bearing numbers

65031 to 65033, flats numbered 1 and 2, Door B are registered

with the Government as Tenements bearing numbers 65034 and

65035, flats numbered 4 to 8, Door B are registered with the

Government as Tenements bearing numbers 65037 to 65041,

flats numbered 1 to 8, Door C are registered with the

Government as Tenements bearing numbers 63945 to 63952 and

flats numbered 2 and 3, Door D are registered with the

Government as Tenements bearing numbers 63954 and 63955.

This block falls on Government property acquired by Deed No.

301 dated 25th September 1957 and the whole block is edged in

red and marked “Block 1” on plan P.D. 2013_635. (HAA 209/

2012, HAA 210/2012, HAA 211/2012, HAA 212/2012).

(14) A block, known as Block 2, Doors A - B,

consisting of sixteen flats of which six are being excluded from

the transfer as they were already transferred by a previous legal

notice, and one site in ir-Rihan, San Ġwann. This block is

bounded on the North-East by Triq ir-Rihan, on the North-West

by Triq it-Tamar and on the South-East by Triq il-Palma. Flats

numbered 2 to 4, Door A are registered with the Government as

Tenements bearing numbers 68929 to 68931, flats numbered 6

to 8, Door A are registered with the Government as Tenements

bearing numbers 68933 to 68935, flats numbered 9, 11, 13 and

15, Door B are registered with the Government as Tenements

bearing numbers 68936, 68938, 68940, 68942 respectively, and

the site is registered with the Government as Tenement No.

52426. This block falls on Government property acquired by

Deed No. 181/70 dated 26th June 1970, by Deed No. 21/81

dated 18th February 1981 and by Deed No. 23/81 dated 25th

February 1981 all in the acts of Notary A. Grech and the whole

block is shown edged in red on plan P.D. 2014_37. (HAA 80/

2013, HAA 69/2011).

(15) A block, known as Block A1, consisting of six flats

of which one flat is being excluded from the transfer as it was

already transferred by a previous legal notice, in Triq l-Erba’

Mwieżeb, San Pawl il-Baħar. This block is bounded on the

North-East, on the North-West and on the South-West by public

passages. Flat numbered 1 is registered with the Government as

Tenement No. 72917 and flats numbered 3 to 6 are registered

with the Government as Tenements bearing numbers 72919 to

72922. This block falls on Government property formerly part

of Tenement No. 50365 and the whole block is edged in red and

marked “Block A1” on plan P.D. 2013_669. (HAA 128/2013).

(16) A block, known as Block E, consisting of thirteen

flats of which one flat is being excluded from the transfer as it

was already transferred by a previous legal notice, in Triq il-

Ħalib it-Tajr, Santa Luċija. This block is bounded on the North-

East by Triq il-Ħalib it-Tajr, on the West by Triq Santa Katerina

Vitale and on the North-West in part by property of the Housing

Authority or its successors in title and in part by Government

property. Flats numbered 1 to 3 are registered with the

Government as Tenements bearing numbers 66930 to 66932 and

flats numbered 5 to 13 are registered with the Government as

Tenements bearing numbers 66934 to 66941. This block falls on

Government property formerly part of ex-services property

16147 and on property acquired by Deed No. 87/77 dated 16th

August 1977 and the whole block is shown edged in red and

marked “Block E” on plan P.D. 2013_621. (HAA 269/2012).

(17) A block, known as Block 10, Doors 7 and 8,

consisting of twelve flats of which four are being excluded from

the transfer as they were already transferred by a previous legal

notice, in Triq il-Gardenja, Santa Luċija. This block is bounded

on the North-West by Triq il-Gardenja, on the South-East by a

public passage and on the North-East by Triq it-Tulipani. Flats

numbered 1 to 3, Door 7 are registered with the Government as

Tenements bearing numbers 64435 to 64437, flat numbered 5,

Door 7 is registered with the Government as Tenement No.

64439, flat numbered 7, Door 7 is registered with the

Government as Tenement No. 64441 and flats numbered 2 to 8,

Door 8 are registered with the Government as Tenements

bearing numbers 64444 to 64450. This block falls on

Government property acquired by Deed No. 16/73 dated 27th

January 1973 in the acts of Notary A. Grech and the whole

block is shown edged in red and marked “Block 10” on plan

P.D. 2014_422 (HAA 39/2014, HAA 86/2011).

(18) A plot of land and a site known as Plots 98 and 99,

at Triq it-Tulipani, forming part of the Santa Luċija Government

Housing Estate, Neighbourhood I, in Santa Luċija, having an

area of approximately 267.57 square metres, bounded on the

North-East by Triq it-Tulipani and on the South-East and on the

North-West by Government property. The plots are subject to a

perpetual emphyteusis as per Deed No. 16/75/P dated 12th June

1978 in the acts of Notary F. Pellegrini, falling on part of

Government property acquired by Deed No. 126/60 dated 7th

May 1960 and by Deed No. 348/59/A dated the 31st of October

1959 both in the acts of Notary A. Attard. The plots are

registered in the Estate Management Department records as

Tenement No. 41518 and is edged in red and marked “No. 10”

on plan L.D. 11_82_70. (HAP 4/2014).

(19) A garage, known as Garage 2 in the Siġġiewi

Housing Estate, Siġġiewi, registered with the Government as

Tenement No. 71771 and is bounded on the North-West and on

the South-East by Government property and on the South-West

by an open space. This garage falls on Government property

acquired by Deed No. 72/98 dated 8th of April 1998 in the acts

of Notary V. Miceli, by Deed No. 246 dated 4th of August 1976

and by Deed No. 7/78 dated 11th January 1978 both in the acts

of Notary A. Grech and is shown edged in red and marked

“Garage No.:2 Property No.: 71771” on plan P.D.

159_82_11_A. (HA 254/98).

(20) A block, known as Block 1, consisting of sixteen

flats of which eight are being excluded from the transfer as they

were already transferred by a previous legal notice, and

excluding the subsoil in Triq il-Mediterran, Valletta. This block

is bounded on the North-West by Government property, on the

South-East by Triq il-Mediterran and on the South-West by Triq

San Kristofru. Flat numbered 1 is registered with the

Government as Tenement No. 62996, flats 3 to 5 are registered

with the Government as Tenements bearing numbers 62998 to

63000, flats numbered 9 and 11 are registered with the

Government as Tenements bearing numbers 63004 and 63006

respectively and flats numbered 15 and 16 are registered with

the Government as Tenements numbered X51793 and X51794.

This block falls on Government property leased for over 30

years and the whole block is shown edged in red and marked

“Block 1” on plan P.D. 2013_731. (HAA 103/2013).

(21) A block, known as Block 2 City Gate Project,

Valletta, bounded on the North-West and on the South-East by

Government property and on the South-West by Triq il-Papa

Piju V. This block falls on Government property formerly part

of Tenements bearing numbers 60447 and 60448 and the whole

block is shown edged in red on plan P.D. 2013_744. (HAA 27/

2013).

(22) A block, known as Block B, Ex-Flores College,

consisting of nine flats of which four are being excluded from

the transfer as they were already transferred by a previous legal

notice, in Triq l-Ifran, Valletta. This block is bounded on the

North-East by property of the Housing Authority or its

successors in title, on the South-West by Government property

and on the North-West by Triq l-Ifran. Flat numbered 4 is

registered with the Government as Tenement No. 68786 and

flats numbered 6 to 9 are registered with the Government as

Tenements bearing numbers 68788 to 68791. This block falls on

Government property formerly part of Tenement No. 83215 and

the whole block is shown edged in red on plan P.D. 2013_741.

(23) A block, known as Block 188F, consisting of

twelve flats of which five are being excluded from the transfer

as they were already transferred by a previous legal notice, and

excluding the subsoil, in Triq Sant’Ursola, Valletta. This block

is bounded on the North-West by Triq Sant’Ursola, on the

North-East and on the South-West by property of the Housing

Authority or its successors in title. Flats numbered 1 and 2 are

registered with the Government as Tenements bearing numbers

62955 and 62956, flats numbered 5, 7 and 10 are registered with

the Government as Tenements bearing numbers 62959, 62961

and 62964 respectively and flats numbered 11 and 12 are

registered with the Government as Tenements bearing numbers

X51785 and X51786. This block falls on Government property

leased over 30 years and the whole block is edged in red and

marked “Block 188F” on plan P.D. 2013_734.(HAA 24/2013).

(24) A plot of land and a site known as Plot 75, at Vjal

il-Labour, forming part of the Xewkija Housing Estate in

Xewkija, Gozo, having an area of approximately 175.64 square

metres and is bounded on the North-East by Vjal il-Labour, on

the South-East by Government property and on the North-West

by property transferred to the Housing Authority. The plot is

subject to a perpetual emphyteusis as per Deed No. 113 dated

the 3rd of October, 1975 in the acts of Notary J. Busuttil. The

plot is registered in the Estate Management Department records

as Tenement No. Z41285 and is edged in red on plan P.D.
