Conservation of Wild Birds (Framework for Allowing a

Derogation Opening an Autumn Live-Capturing Season

for Song Thrush and Golden Plover) (Amendment No. 2)

Regulations, 2014

BY VIRTUE of the powers conferred by articles 61 and 62 of

the Environment and Development Planning Act, the Minister for

Sustainable Development, the Environment and Climate Change has

made the following regulations:-

The title of these regulations is the Conservation of Wild Citation.

Birds (Framework for Allowing a Derogation Opening an Autumn

Live-Capturing Season for Song Thrush and Golden Plover)

(Amendment No. 2) Regulations, and these regulations shall be read

and construed as one with the Conservation of Wild Birds S.L. 504.113

(Framework for Allowing a Derogation Opening an Autumn Live-

Capturing Season for Song Thrush and Golden Plover) Regulations,

hereinafter referred to as "the principal regulations".

In the proviso to sub-regulation (2) of regulation 3 of the Amends

principal regulations, for the words "shall not in any case exceed 38 regulation

shall be added the following new proviso

"Provided further that if such licensee is in possession of

both the license issued under these regulations and the license

issued in terms of the Framework for Allowing a Derogation

Opening an Autumn live-capturing season for finches, and

provided that a live-capturing station is used by such licensee

exclusively for the purpose of live-capturing Golden Plover and,

or Song Thrush and not for the purpose of live-capturing of

finches, such licensee may use on this live-capturing station

nets with a mesh size of not less than 30 mm, and the largest net

size shall not exceed 60 square metres.".

In the proviso to paragraph (e) of regulation 7 of the

principal regulations, for the words "shall not in any case exceed 38

square metres;" there shall be substituted the words "shall not in any

case exceed 38 square metres:" and immediately thereafter there shall

be added the following new proviso

"Provided further that if such licensee is in possession of

both the licence issued under these regulations and the licence

issued in terms of the Conservation of Wild Birds (Framework

for Allowing a Derogation Opening an Autumn Live-Capturing

season for Finches Regulations, and provided that a live-

capturing station is used by such licensee exclusively for the

purpose of live-capturing Golden Plover and, or Song Thrush

and not for the purpose of live-capturing of Finches, such

licensee may use on this live-capturing station nets with a mesh

size of not less than 30 mm, and the largest net size shall not

exceed 60 square metres;".
