Housing Authority (Transfer of Assets) (No. 3) Order, 2014

IN exercise of the powers conferred by article 12 of the

Housing Authority Act, the President of Malta has made the

following order:-

The title of this order is the Housing Authority (Transfer

of Assets) (No. 3) Order, 2014.

The property described in article 4 of this order is hereby

specified for the purpose of article 12 of the Housing Authority

Act.

The property specified in article 2 of this order shall be

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 19th of June, 2014.

The property referred to in article 2 of this order is the

following, that is to say

(1) A block, known as Block C5 consisting of sixteen

flats, of which four are being excluded from the transfer as they

were already transferred through another legal notice at Ta’ Paris

Housing Estate, Birkirkara. This block is bounded on the North-

East by Triq Fonsu Marija Galea, and on the South-East and on

the South-West by a public passage. Flats numbered 2 and 4 are

registered with the Government as Tenements numbered 66997 and

66999 respectively and flats numbered 7 to 16 are registered with

the Government as Tenements numbered 67002 to 67011. This

block falls on Government property formerly part of Tenement

No. 51057 and the whole block is shown edged in red and marked

“Block C5” on plan P.D. 2013_747. (HAA 185/2013, HAA

2/2013).

(2) A block, known as Block B consisting of sixteen

flats, of which four are being excluded from the transfer as they

were already transferred through another legal notice, in Triq San

Franġisk Saverju, Birżebbuġia. This block is bounded on the North-

West, South-East and on the South-West by Government property.

Flats numbered 2 and 3 are registered with the Government as

Tenements bearing numbers 69061 and 69062 respectively, flats

numbered 6 to 13 are registered with the Government as Tenements

bearing numbers 69065 to 69072 and flats numbered 15 and 16

are registered with the Government as Tenements bearing numbers

69074 and 69075 respectively. This block falls on Government

property formerly part of Tenement No. 50794 and the whole

block is shown edged in red and marked “Block B” on plan P.D.

2014_274. (HAA 32/2014).

(3) A block, known as Block D consisting of sixteen

flats, of which four are being excluded from the transfer as they

were already transferred through another legal notice, in Triq San

Gwann, Birżebbuġia. This block is bounded on the North-West,

on the South-East and on the South-West by Government property.

Flats numbered 1 and 2 are registered with the Government

as Tenements bearing numbers 72060 and 72061 respectively,

flat numbered 5 is registered with the Government as Tenement

No. 72064 and flats numbered 7 to 16 are registered with the

Government as Tenements bearing numbers 72066 to 72075. This

block falls on Government property formerly part of Tenement

No. 50794 and the whole block is shown edged in red and marked

“Block D” on plan P.D. 2014_275. (HAA 33/2014).

(4) A block, known as Binja F Sciberras consisting

of thirty-two flats, of which nineteen are being excluded from the

transfer as they were already transferred by a previous legal notice

and excluding the underlying property in Triq Pietro Floriani and

Pjazza Filippo Sciberras, Floriana. This block is bounded on the

North-West by Triq San Franġisk, on the South-West by Triq

Pietro Floriani and on the South-East by Triq il-Kappuċini. Flats

numbered 1 to 4 Entrance A are registered with the Government

as Tenements bearing numbers 77568 to 77571, flats numbered 6

and 8 Entrance A are registered with the Government as Tenements

bearing numbers 77573 and 77575 respectively, flat numbered 1

Entrance B is registered with the Government as Tenement No.

77576, flats numbered 3 to 8 Entrance B are registered with the

Government as Tenements bearing numbers 77578 to 77583 and

the garage is registered with the Government as Tenement No.

78106. This block falls on unregistered Government property and

the whole block is shown edged in red and marked “A” and “B” on

plan P.D. 2013_387. (HAM 6/92, HAA 58/2014, HAA 59/2014).

(5) The administration of a block, known as Block

3 consisting of nine flats and excluding the underlying property

in Triq Sant’Anna, Triq is-Sur and Triq il-Miratur, Floriana. This

block is bounded on the North-East by Triq is-Suq, on the South-

West by Triq il-Miratur and on the South-East by Triq Sant’Anna.

This block consists of three entrances as follows

(a) three flats accessible from a common entrance

bearing Door No. 46 and registered with the Government as

Tenements bearing numbers 63366 to 63368;

(b) three flats accessible from a common entrance

bearing Door No. 7 and registered with the Government as

Tenements bearing numbers 63369 to 63371; and

(c) three flats accessible from a common entrance

bearing Door No. 71 and registered with the Government as

Tenements bearing numbers 63372 to 63374.

The land where this block is located falls on property

which is in the course of being acquired by Government. The

whole block is shown edged in red and marked “Block 3” on plan

P.D. 2013_644. (HAA 196/2012, HAA 152/2012, HAA 192/2012).

(6) Door No. 13, consisting of three flats and

excluding the underlying property in Triq Pietru Floriani, Floriana

and registered with the Government as Tenements bearing numbers

63709 to 63711. This block is bounded on the North-West by

Triq Sant’Anna, on the North-East by Triq Pietro Floriani and on

the South-West by property in the course of acquisition by the

Government. The land where this block is located falls on property

which is in the course of being acquired by Government. The

whole block is shown edged in red on plan P.D. 2013_656. (HAA

151/2012).

(7) Two blocks, known as Block D and Block E at tar-

Rabbat Housing Estate, Ħamrun and are bounded on the North-

East in part by Government property and in part by a public open

space and on the South-West and on the South-East in part by

Government property and in part by a public passage. These blocks

fall on Government property acquired by President’s Declaration

116/2005 dated the 3rd of February 2005 and by Deed No. 10/95

dated the 1st of February 1995 in the acts of Notary V. Miceli and

are shown edged in red and marked “Blk. D” and “Blk. E” on plan

P.D. No. 2014_220, as follows

(a) Block D consists of eight flats of which one is being

excluded from the transfer as it was already transferred by

a previous legal notice. Flats numbered 1 to 4 are registered

with the Government as Tenements bearing numbers 66665

to 66668 and flats numbered 6 to 8 are registered with the

Government as Tenements bearing numbers 66670 to 66672;

and

(b) Block E consists of eight flats of which one is being

excluded from the transfer as it was already transferred by

a previous legal notice. Flats numbered 1 to 3 are registered

with the Government as Tenements bearing numbers 66673

to 66675 and flats numbered 5 to 8 are registered with the

Government as Tenements bearing numbers 66677 to 66680.

(8) A plot of land consisting of Plots 21 to 24 in Triq

Giovanni Ricasoli and Triq it-Turretta, Kalkara and is bounded on

the North-East by Triq it-Turetta, on the South-East by property

transferred to the Housing Authority and on the North-West by Triq

Giovanni Ricasoli. Plots numbered 21 to 24 are registered with the

Government as Tenements bearing numbers X06143 to X06146.

The land where these plots are located falls on Government

property acquired by President’s Declaration No. 553 dated the

11th of June 2014 and by the Building Development Areas Act

(Act I of 1983) and is edged in red on plan P.D. 58_96_2. (HAM

134/86).

(9) A block known as Block 1, Entrances A, B and C

at Triq il-Villa tal-Ammiral, Triq l-Għassieli and Triq tas-Salvatur,

Kalkara and the whole block is bounded on the South-East by Triq

l-Għassieli, on the South-West by Triq il-Villa tal-Ammiral and

on the North-East by Triq tas-Salvatur. This block falls on part of

ex-Services property 16553 and is shown edged in red and marked

“Block 1” on plan P.D. 2013_675, as follows

(a) Entrance A consists of eight flats and a site of

which one flat is being excluded from the transfer as it was

already transferred by a previous legal notice. Flat numbered

1 is registered with the Government as Tenement No. 76295

and flats numbered 3 to 8 are registered with the Government

as Tenements bearing numbers 76297 to 76302;

(b) Entrance B consists of eight flats, six garages and

one shop of which one flat is being excluded from the transfer

as it was already transferred by a previous legal notice. Flats

numbered 1 to 5 are registered with the Government as

Tenements bearing numbers 76480 to 76484, flats numbered

7 and 8 are registered with the Government as Tenements

bearing numbers 76486 and 76487 respectively and garages

numbered 1 to 7 are registered with the Government as

Tenements bearing numbers 76791 to 76797; and

(c) Entrance C consists of eight flats which are

registered with the Government as Tenements bearing

numbers 76488 to 76495. (HAA 246/2012, HAA 247/2012,

HAA 70/2011).

(10) A plot of land consisting of plots 293 to 295,

having an area of approximately 433.50 square metres in Triq

l-Argentina and Triq Gibiltà, Naxxar, bounded on the North-East

by Triq Gibiltà, on the South-West by property of the Housing

Authority or its successors in title and on the North-West by Triq

l-Argentina. This land falls on Government property acquired by

President’s Declaration No. 71 dated 23rd of January 2012, by

Deed No. 9/97 dated the 29th of November 1997 both in the acts

of Notary V. Miceli, by President’s Declaration No. 468 dated the

14th of May 2014 and by Deed dated the 28th of August 1974 in

the acts of Notary A. Grech, which is edged in red on plan P.D.

2012_469_2. (HAM 854/88).

(11) A block, known as Block 14 consisting of sixteen

flats, of which three are being excluded from the transfer as they

were already transferred through another legal notice, and including

surrounding gardens in Triq l-Istefanotis and Triq R. Caruana

Dingli, San Gwann. This block is bounded on the North-West by

Triq R. Caruana Dingli, on the North-East by a public road and

on the South-East by Triq l-Istefanotis. Flats 1 and 2, Entrance A

are registered with the Government as Tenements bearing numbers

71408 and 71409 respectively, flats numbered 4 to 8 Entrance A

are registered with the Government as Tenements bearing numbers

71411 to 71415, flats numbered 9 to 12 Entrance B are registered

with the Government as Tenements bearing numbers 71416 to

71419 and flats numbered 14 and 15 Entrance B are registered

with the Government as Tenements bearing numbers 71421 and

71422 respectively. This block falls on Government property

formerly registered as part of Tenement No. 51328 and the whole

block is shown edged in red and marked “Block 14” on plan P.D.

2013_722. (HAA 93/2013, HAA 94/2013).

(12) A block, known as Block C consisting of sixteen

flats, of which one is being excluded from the transfer as it was

already transferred through another legal notice, three garages

and including surrounding gardens and passages leading to the

block in Triq ic-Cikwejra, Santa Lucija. This block is bounded

on the North-West by a public open space, on the South-West by

Triq ic-Cikwejra and on the South-East by Triq Guljetta Lopez.

Flats numbered 2 to 8 Door A are registered with the Government

as Tenements bearing numbers 66610 to 66616, flats numbered 9

to 16 Door B are registered with the Government as Tenements

bearing numbers 66617 to 66624 and garages numbered 1 to

3 are registered with the Government as Tenements bearing

numbers 72271, 72272 and 72633 respectively. This block falls on

Government property acquired by Deed No. 49/78 dated the 24th

of March 1973 in the acts of Notary A. Grech and by Deed No.

93/78 dated the 27th of February 1978 in the acts of Notary Borg

Barthet and the whole block is shown edged in black and marked

“Block C” on plan P.D. 2013_608_A. (HAA 268/2012, HAA

34/2014).

(13) A plot of land, known as Plot 6 at Triq in-Narcis,

Santa Luċija, having an area of approximately 144 square metres

and is bounded on the North-West and on the South-East by

property transferred to the Housing Authority and on the North-East

by Triq in-Narcis. The plot is subject to a temporary emphyteusis

for a period of 150 years as per Deed No. 388/59 dated the 21st of

November 1959 in the acts of Notary A. Attard, by Deed No. 96/61

in the acts of Notary H. Borg and by Deed No. 16/73 dated the 27th

of January 1973 in the acts of Notary A. Grech and is registered in

the Estate Management Directorate records as Tenement No. 65536

and is shown edged in red and marked “No. 6 (P. 73)” on plan L.D.

11_80_71 (HAP 5/2013).

(14) Car spaces 1, 5 and 6 in a block known as “Clock

Tower Block T1” in Tignè Point, Sliema, shown on plan P.D.

194_2004_12 as follows

(a) car space 1 has an area of approximately 14 square

metres and is bounded on the South-West, South-East and

North-East by property of MIDI plc. Car space 1 is registered

with the Government as Tenement No. E20728 and is located

at Level 0 and shown edged in red and marked “01” on plan

P.D. 194_2004_12;

(b) car space 5 has an area of approximately 13

square metres and is bounded on the South-East by property

transferred to the Housing Authority or its successors in

title and on the South-West and North-East by property of

MIDI plc. Car space 5 is registered with the Government as

Tenement No. E20731 and is located at Level 0 and shown

edged in red and marked “05” on plan P.D. 194_2004_12;

and

(c) car space 6 has an area of approximately 13

square metres and is bounded on the South-East by property

transferred to the Housing Authority or its successors in

title and on the South-West and North-East by property of

MIDI plc. Car space 6 is registered with the Government as

Tenement No. E20732 and is located at Level 0 and shown

edged in red and marked “06” on plan P.D. 194_2004_12.

These car spaces fall on Government property acquired

by Deed No. 133 dated the 30th of June, 2005 and by Deed No.

213 dated the 19th of October 2005, both in the acts of Notary V.

Miceli. (HAA 27/2008).

(15) A block, known as Block Z1 consisting of

sixteen flats, of which eight are being excluded from the transfer

as they were already transferred through another legal notice, and

including surrounding gardens and passages leading to the block

in the Ta’ Farzina Housing Estate in the limits of Qormi. This

block is bounded on the South-West by Triq Ta’ Farzina, on the

South-East by Triq il-Ħelsien and on the North-West by a public

passage. Flats numbered 1 to 3 are registered with the Government

as Tenements bearing numbers 70163 to 70165, flats numbered 5

and 6 are registered with the Government as Tenements bearing

numbers 70167 and 70168 respectively, flats numbered 10 and 11

are registered with the Government as Tenements bearing numbers

70172 and 70173 respectively and flat numbered 15 is registered

with the Government as Tenement No. 70177. This block falls

on Government property acquired by Deed No. 134/82 dated the

26th of May 1982 and by Deed No. 323/75/G dated the 29th of

October 1975 both in the acts of Notary A. Grech and the whole

block is shown edged in red and marked “Block Z1” on plan P.D.

2013_594. (HAA 1/2013).

(16) A block, known as Block Z2 consisting of

sixteen flats, of which seven are being excluded from the transfer

as they were already transferred through another legal notice, and

including surrounding gardens and passages leading to the block in

the Ta’ Farzina Housing Estate in the limits of Qormi. This block

is bounded on the South-West by Triq Ta’ Farzina, on the North-

West by a public passage and on the North-East by Triq id-Deheb

Fin. Flats numbered 2 to 4 are registered with the Government as

Tenements bearing numbers 70180 to 70182, flats numbered 9 to 11

are registered with the Government as Tenements bearing numbers

70187 to 70189 and flats numbered 13 to 15 are registered with the

Government as Tenements bearing numbers 70191 to 70193. This

block falls on Government property acquired by Deed No. 134/82

dated the 26th of May 1982 in the acts of Notary A. Grech and the

whole block is shown edged in red and marked “Block Z2” on plan

P.D. 2013_595. (HAA 241/2011).

(17) A block, known as Block Z3 consisting of

sixteen flats, of which five are being excluded from the transfer

as they were already transferred through another legal notice, and

including surrounding gardens and passages leading to the block

in the Ta’ Farzina Housing Estate in the limits of Qormi. This

block is bounded on the South-West by Triq Ta’ Farzina, on the

North-West by a public passage and on the North-East by Triq id-

Deheb Fin. Flat numbered 2 is registered with the Government as

Tenement No. 70196, flats numbered 4 to 7 are registered with

the Government as Tenements bearing numbers 70198 to 70201

and flats numbered 9 to 11 are registered with the Government as

Tenements bearing numbers 70203 to 70205 and flats numbered

14 to 16 are registered with the Government as Tenements bearing

numbers 70208 to 70210. This block falls on Government property

acquired by Deed No. 134/82 dated the 26th of May 1982 in the

(18) A block, known as Block Z4 consisting of

sixteen flats, of which three are being excluded from the transfer

as they were already transferred through another legal notice, and

including surrounding gardens and passages leading to the block in

the Ta’ Farzina Housing Estate in the limits of Qormi. This block

is bounded on the South-West by Triq Ta’ Farzina, on the North-

East by Triq id-Deheb Fin and on the North-West by a public

passage. Flats numbered 1 to 4 are registered with the Government

as Tenements bearing numbers 70211 to 70214, flats numbered

6 is registered with the Government as Tenement No. 70216,

flats numbered 8 and 9 are registered with the Government as

Tenements bearing numbers 70218 and 70219 and flats numbered

11 to 16 are registered with the Government as Tenements bearing

numbers 70221 to 70226. This block falls on Government property

acquired by Deed No. 51/80/G dated the 2nd of April 1980 in the

(19) A block, known as Block Z5 consisting of

sixteen flats, of which three are being excluded from the transfer

as they were already transferred through another legal notice, and

including surrounding gardens and passages leading to the block in

the Ta’ Farzina Housing Estate in the limits of Qormi. This block is

bounded on the South-West by Triq Ta’ Farzina, on the North-East

by Triq id-Deheb Fin and on the North-West by a public passage.

Flats numbered 1 to 11 are registered with the Government as

Tenements bearing numbers 70227 to 70237 and flats numbered

13 and 16 are registered with the Government as Tenements

bearing numbers 70239 and 70242 respectively. This block falls

on Government property acquired by Deed No. 51/80/G dated the

2nd of April 1980 and by Deed No. 182/76/G dated the 9th of June

1976, both in the acts of Notary A. Grech and by Deed No. 81/85

dated the 8th of March 1985 in the acts of Notary F. Portelli and

the whole block is shown edged in red and marked “Block Z5” on

plan P.D. 2013_598. (HAA 3/2013).

(20) A block, known as Block Z6 consisting of sixteen

flats, of which eleven are being excluded from the transfer as

they were already transferred through another legal notice, and

including surrounding gardens and passages leading to the block

in the Ta’ Farzina Housing Estate in the limits of Qormi. This

block is bounded on the West by Triq Ta’ Farzina, on the North-

East by Triq id-Deheb Fin and on the North-West by a public

passage. Flat numbered 3 is registered with the Government

as Tenement No. 70245, flat numbered 8 is registered with the

Government as Tenement No. 70250, flats numbered 10 and 11

are registered with the Government as Tenements bearing numbers

70252 and 70253 respectively and flat numbered 15 is registered

with the Government as Tenement No. 70257. This block falls on

Government property acquired by Deed No. 134/82 dated the 26th

of May 1982 in the acts of Notary A. Grech and by Deed No. 81/85

dated the 8th of March 1985 in the acts of Notary F. Portelli and

the whole block is shown edged in red and marked “Block Z6” on

plan P.D. 2013_599. (HAA 4/2013).

(21) Four blocks known as Blocks 1, 2, 11 and 12 in

Vjal de la Cruz, Qormi, as follows

(a) Block 1 consists of eight flats of which four

are being excluded from the transfer as they were already

transferred through another legal notice and is bounded on the

North-East and on the North-West by Government property

and on the South-East by Vjal de la Cruz. Flats numbered

3 and 4 are registered with the Government as Tenements

bearing numbers 64166 and 64167 respectively and flats

numbered 7 and 8 are registered with the Government as

Tenements bearing numbers 64170 and 64171 respectively.

This block falls on Government property Tenement No. 51197

and the whole block is edged in red and marked “Block 1” on

plan P.D. 2013_637;

(b) Block 2 consists of eight flats of which four

are being excluded from the transfer as they were already

transferred through another legal notice and is bounded on

the South-West and North-West by Government property

and South-East by Vjal de la Cruz. Flats numbered 1 and 2

are registered with the Government as Tenements bearing

numbers 64172 and 64173 respectively and flats numbered

7 and 8 are registered with the Government as Tenements

bearing numbers 64178 and 64179 respectively. This block

falls on Government property Tenement No. 51197 and the

whole block is edged in red and marked “Block 2” on plan

P.D. 2013_637;

(c) Block 11 consists of eight flats of which four

are being excluded from the transfer as they were already

transferred through another legal notice and is bounded on

the North and North-West by a public passage and on the

South-East by Vjal de la Cruz. Flats numbered 1, 5, 6 and

8 are registered with the Government as Tenements bearing

numbers 64236, 64240, 64241 and 64243 respectively. This

block falls on Government property Tenement No. 51197 and

the whole block is edged in red and marked “Block 11” on

plan P.D. 2013_629; and

(d) Block 12 consists of eight flats of which six

are being excluded from the transfer as they were already

transferred through another legal notice and is bounded on the

North and North-West by a public passage and on the South-

East by Vjal de la Cruz. Flats numbered 2 and 8 are registered

with the Government as Tenements bearing numbers 64245

and 64251 respectively. This block falls on Government

property Tenement No. 51197 and the whole block is edged

in red and marked “Block 12” on plan P.D. 2013_629. (HAA

5/2013, HAA 6/2013, HAA 7/2013, HAA 8/2013).

(22) A block known as Block E5 consisting of eight

flats of which six are being excluded from the transfer as they were

already transferred through another legal notice in the Ta’ Xbiex

Housing Estate, Ta’ Xbiex. This block is bounded on the West by

Government property, on the South by a public passage and on the

North by a public road. Flats numbered 2 and 7 are registered with

the Government as Tenements bearing numbers 71473 and 71478

respectively. This block falls on Government property acquired

by Deed No. 193/77/G dated the 21st of September, 1977 in the

acts of Notary A. Grech and the whole block is edged in red and

marked “Block E5” on plan P.D. 2013_640. (HAA 227/2012).
