Transfer of Pensions paid under the Social Security Act

(Amendment) Regulations, 2013

IN exercise of the powers conferred by article 134 of the Social

Security Act, the Minister for Justice, Dialogue and the Family, has

made the following regulations:-

Reg. 1 Citation. — Transfer of Pensions paid under the Social Security Act Open official source

The title of these regulations is the Transfer of Pensions

paid under the Social Security Act (Amendment) Regulations, 2013

and these regulations shall be read and construed as one with the

Transfer of Pensions paid under the Social Security Act Regulations,

hereinafter referred to as "the principal regulations".

Reg. 2 Amends regulation 1 of the principal regulations. — Transfer of Pensions paid under the Social Security Act Open official source

In sub-regulation (3) of regulation 1 of the principal

regulations, for the words "Part II" there shall be substituted the

words "Part V".

In the definition "relevant pension" in regulation 2 of the

principal regulations, for the words "article 26 of the Act", there shall

be substituted the words "Part V of the Act".

Reg. 4 Amends regulation 3 of the principal regulations. — Transfer of Pensions paid under the Social Security Act Open official source

In regulation 3 of the principal regulations, for the words

"any rights to relevant pensions" there shall be substituted the words

"any rights to a relevant pension".

Reg. 5 Amends regulation 5 of the principal regulations. — Transfer of Pensions paid under the Social Security Act Open official source

Sub-regulation (2) of regulation 5 of the principal

regulations shall be substituted by the following

"(2) A statement of entitlement shall remain valid for a

period of ninety days beginning with the day on which the

transferor is provided with the finalised proposal of transfer

from the administrator of the EU scheme.".
