Housing Authority (Transfer of Assets) (No. 5) Order, 2013

IN exercise of the powers conferred by article 12 of the

Housing Authority Act, the President of Malta has made the

following order:-

The title of this order is the Housing Authority (Transfer

of Assets) (No. 5) Order, 2013.

The property described in article 4 of this order is hereby

specified for the purpose of article 12 of the Housing Authority

Act.

The property specified in article 2 of this order shall be

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 22nd of November, 2013.

The property referred to in article 2 of this order is the

following, that is to say

(1) The administration of a block known as “Okella

Agius” at 39, Triq Hal Qormi in Hamrun, consisting of 48

flats registered with the Government as Tenements 71680 to

71715 and 72741 to 72752 and is bounded on the North-West

by Triq Hal Qormi, on the North-East and on the South-East

by third party property. The transfer shall have effect from the

ground floor upwards for the land marked, edged and shaded

in red and from the first floor upwards for the land marked

and edged in red on plan P.D. 2013_502. The land where

the block is located is in the course of being acquired by the

Government and the whole block is shown edged in red on

plan P.D. 2013_502. (HAA 113/2012).

(2) A plot of land consisting of Plots 87 to 89 at tad-

Dib Housing Estate in Mosta, having an area of approximately

724.50 square metres and is bounded on the North by Triq il-

Bdoti, on the South by property of the Housing Authority or

its successors in title and on the East by Triq il-Mitħna. The

plot falls on Government property acquired by President’s

Declaration No. 880 dated the 20th of September, 2013 and

by President’s Declaration No. 33 dated the 17th of January,

2013 and is shown edged in red on plan P.D. 2012_700_2.

(HAM12/87).

(3) A block consisting of eighteen flats and twenty-

one garages at Entrances A and B in Triq Ġuże Ellul Mercer

and at Entrance E in Triq il-Gostra in Msida, having an area

of approximately 1, 101 square metres and is bounded on

the South by Triq Ġuże Ellul Mercer, on the South-West by

Triq il-Gostra and on the North by property of the Housing

Authority or its successors in title. The block falls on

Government property acquired by Deed No. 88/95 dated the

18 th of April, 1995 in the acts of Notary V.Miceli, by Deed

No. 51 dated the 4th of April, 2011 in the acts of Notary D.

Charles and part of an old passage. The whole block is shown

edged in red on plan P.D. 2009_209_1. (HAM 44/98 Vol. II).

(4) A plot of land consisting of Plots 296 to 298

in Triq Ċipru and Triq Gibilità in Naxxar, having an area

of approximately 416 square metres and is bounded on the

North-West by Triq Gibilità, on the South-East by property

of the Housing Authority or its successors in title and on the

South-West by Triq Ċipru. The plot falls on Government

property acquired by President’s Declaration No. 70 dated

23rd January, 2012, by President’s Declaration No. 963 dated

9th October, 2013, by President’s Declaration No. 71 dated

dated 23rd January, 2012 and by Deed No. 9/97 dated 29th

November, 1997 in the acts of Notary V.Miceli and is shown

edged in red on plan P.D. 2012_469_1. (HAM 854/88).

(5) A site, falling on part of Ta’ Erba’ Mwiezeb

Housing Estate, at Triq il-Lampuki in St.Paul’s Bay, having

an area of approximately 63 square metres and is bounded

on the North-East by property transfered to the Housing

Authority, on the South-West by Government property and

on the North-West by Triq iz-Zerniq. The site is subject

to a perpetual emphyteusis as per Deed dated 6th October,

1976 in the acts of Notary A. Grech. The site falls on part of

Government property formerly registered as Tenement No.

50356 and is registered in the Estate Management Directorate

records as part of Tenement No. 41564 and is shown edged in

red on plan P.D. 84_87_4. (HAP 5/2006).

(6) Two plots of land at Bubaqra in Żurrieq , as

follows:-

(a) a plot of land, known as Site A, consisting

of Plots 1 to 5 and 15, having an area of approximately

1, 225.45 square metres and is bounded on the North-

East by Triq il-Kan Vincenz Balzan, on the South-East

by Triq il-Mons Pietru Pawl Pullicino and on the South-

West by Triq l-Għadir. Plots 1 to 5 are registered as

Tenements X03853 to X03857 and Plot 15 is registered

as Tenement X03867 and this site is shown edged in red

and marked “A” on plan P.D. 11_88_7;

(b) a plot of land, known as Site B, consisting

of Plots 16 to 25, having an area of approximately 1,

800.75 square metres and is bounded on the North-East

by property of the Housing Authority or its successors in

title, on the South-West by Triq il-Kan Vincenz Balzan

and on the South-East by Triq il-Mons Pietru Pawl

Pullicino. Plots 16 to 25 are registered as Tenements

X03868 to X03877 and this site is shown edged in red

and marked “B” on plan P.D. 11_88_7;

The land where these sites are located is Government property

acquired by President’s Declaration No. 308 dated 7th March, 2012

and by Deed No. 132 dated 18th May, 1988 in the acts of Notary

V.Miceli and on Government property formerly part of Tenement

50821E. (HAM181/82).
