(CAP. 65)
Passenger Transport Services (Amendment No. 3)
Regulations, 2013
IN exercise of the powers conferred by 43 of the Authority for
Transport in Malta Act and by article 54 of the Traffic Regulation
Ordinance, the Minister for Transport and Infrastructure has, after
consultation with the Authority for Transport in Malta, made the
following regulations:-
The title of these regulations is the Passenger Transport Citation.
Services (Amendment No. 3) Regulations, 2013 and these regulations
shall be read and construed as one with the Passenger Transport S.L.499.56
Services Regulations, hereinafter referred to as "the principal
regulations".
Paragraph (b) of sub-regulation (2) of regulation 28 of the Amends
regulation 28 of
principal regulations shall be substituted by the following
the principal
regulations.
"(b) has been manufactured for not more than seven
years and has been first registered for use on the road for not
more than five years;".
Sub-regulation (4) of regulation 116 of the principal Amends
regulation 116
regulations shall be substituted by the following
of the principal
regulations.
"(4) Notwithstanding the proviso to regulation 28(2)(b),
a tail-lift van which is not new shall be issued with a passenger
transport vehicle licence if
(a) it complies with all the other conditions
imposed by these regulations and any other applicable
legislation in force in Malta, including the conditions in
regulation 28(2);
(b) the application is submitted by a person who
on the date of coming into force of these regulations holds
an operator’s licence in terms of these regulations;
(c) the applicant has submitted, at any time after
the coming into force of these regulations but before or
together with the submission of an application for a
transport vehicle licence for a tail-lift van in terms of this
regulation, for each tail-lift van to be licensed in terms of
this regulation, an application to the Authority in order to
surrender one passenger transport vehicle licence issued
with respect to a tail-lift van which was already licensed to
carry passenger transport services before the 1st November
2009
Provided that such tail-lift van shall only be used in the
road passenger transport operation of the operator who has
applied for its passenger transport vehicle licence.".
