MERCHANT SHIPPING ACT

(CAP. 234)

Merchant Shipping (Maritime Labour Convention)

(Amendment) Rules, 2013

IN exercise of the powers conferred by articles 90, 106, 108,

122C, 148, 149, 152, 153, 154, 163, 168A and 374 of the Merchant

Shipping Act, the Minister for Transport and Infrastructure, has made

the following rules:-

(1) The title of these rules is the Merchant Shipping Citation and

(Maritime Labour Convention) (Amendment) Rules, 2013 and these commencement.

rules shall be read and construed as one with the Merchant Shipping L.N. 145 of

2013. (Maritime Labour Convention) Rules, 2013, hereinafter referred to as

"the principal rules".

(2) These rules shall be deemed to have come into force on the

20th August, 2013.

Rule 2 of the principal rules shall be amended as follows

Amends rule 2

of the principal

rules.

(a)

immediately after the definition "the Act" in sub-

rule (1) thereof, there shall be added the following new

definition

" "competent authority", in relation to Malta,

means the Registrar-General and, in relation to other

States, means the national maritime administration

maintained by those States;";

(b) in the definition "inspector" in sub-rule (1) thereof,

for the words "Registrar-General" there shall be substituted the

words "competent authority";

(c)

in the definition "proper authority" in sub-rule (1)

thereof, for the words "Registrar-General" there shall be

substituted the words "competent authority";

(d) immediately after the definition "proper authority"

in sub-rule (1) thereof, there shall be added the following new

definition

" "Registrar-General" shall have the same meaning

as is assigned to it in the Act;"; and

(e)

sub-rule (5) thereof shall be deleted.

In rule 3(2)(c) of the principal rules, for the word "Rules"

there shall be substituted the word "Regulations".

In rule 6(2)(b) of the principal rules, for the words

"Director-General" there shall be substituted the words "competent

authority".

Rule 10 of the principal rules shall be amended as follows

(a)

in sub-rule (1) thereof, for the words "Registrar-

General" there shall be substituted the word "authority"; and

(b)

sub-rule (3) thereof shall be deleted.

In rule 17 of the principal rules, for the words "Registrar-

General" there shall be substituted the words "competent authority".

In rule 40(2) of the principal rules, for the words "if the

Registrar-General determines" there shall be substituted the words "if

the competent authority determines".

In rule 50(1) of the principal rules, in the definition "able

seaman" for the words "Merchant Shipping (A.B. and E.D.H.

Certificates) Regulations" and the corresponding marginal note

"234.15" there shall be substituted the words "Merchant Shipping

(Training and Certification) Regulations" and the corresponding

marginal note "234.17" respectively.

In rule 92(1) of the principal rules, for the words "a crew of

fifteen or more" there shall be substituted the words "fifteen seafarers

or more".

In rule 98(2) of the principal rules, the words "(including

fishing vessels)", wherever they occur, shall be deleted.

In rule 109 of the principal rules, for the words "Registrar-

General", wherever they occur, there shall be substituted the words

"competent authority".

In rule 115 of the principal rules, for the words "Registrar-

General" there shall be substituted the words "competent authority".

In rule 130(1) of the principal rules, the words "the

Merchant Shipping (Employment of Young Persons in Merchant

Ships) Regulations, 2001" shall be deleted.

Immediately after paragraph 17.13. of Appendix I of the Amends

Third Schedule to the principal rules, for the words "17.4." and Appendix

I of

Third Schedule

"17.5." there shall be substituted the words "17.14." and "17.15.", to

the principal

rules.

respectively.
