TRAFFIC REGULATION ORDINANCE

(CAP. 65)

Taxi Services (Amendment) Regulations, 2012

IN exercise of the powers conferred by article 43 of the

Authority for Transport in Malta Act and by article 54 of the Traffic

Regulation Ordinance, the Minister for Infrastructure, Transport and

Communications has, after consultation with the Authority for

Transport in Malta, made the following regulations:-

(1) The title of these regulations is the Taxi Services

(Amendment) Regulations, 2012 and these shall be read and

construed as one with the Taxi Services Regulations, hereinafter

referred to as "the principal regulations".

(2) Regulation 7 shall come into force on such a date as the

Minister responsible for transport may by notice in the Gazette

establish.

Regulation 2 of the principal regulations shall be amended

as follows

(a) immediately after the definition "carriageway" there

shall be added the following new definition

" " ‘category L5e vehicle’, ‘category L6e vehicle’

and ‘category L7e vehicle’ " have the same meanings as in

Directive 2002/24/EC of the European Parliament and of

the Council of 18 March 2002 relating to the type-approval

of two or three-wheel motor vehicles;";

(b) in the definition "electric mini cab" for the words

"an electric quadricycle vehicle" there shall be substituted the

words "an electrically propelled vehicle";

(c)

the definition "electric quadricycle" shall be deleted;

and

(d) immediately after the definition "electric mini cab

stand" there shall be inserted the following new definition

" "electrically propelled vehicle" means an

electrically propelled vehicle, which is used for the

carriage of passengers by road and which -

(a) is a category L5e vehicle or a category

L6e vehicle or a category L7e vehicle;

(b) for the purposes of these regulations, has

a maximum speed which does not exceed 45 km

per hour; and

(c) has an unladen mass not exceeding

550kg;".

Paragraph (b) of sub-regulation (1) of regulation 11 of the Amends

principal regulations shall be substituted by the following new regulation

"(b) is the holder of the appropriate driving

licence in respect of the vehicle category being

driven, in accordance with the Motor Vehicles

(Driving Licences) Regulations;".

In sub-regulation (4) of regulation 24 of the principal Amends

cabs in category L5e;".

In sub-regulation (3) of regulation 42 of the principal Amends

regulations for the words "ensure that copies of all fiscal receipts regulation

Provided that the taximeter shall measure distance travelled in units of 100 metres

each for the purpose of charging the rates stipulated above

Provided further that on the 25th December and on the 1st January of each year

there shall be a flat additional charge of €7.00 for every trip.

There shall be a waiting charge of €7 per hour or part thereof while the taxi speed

is less than 20 km/h provided that this charge shall not trigger off unless the speed

of the taxi is less than 20 km/h for at least three continuous minutes

Provided that the waiting time shall be calculated in units of 10 seconds each for

the purpose of the waiting charge. "; and

(b) for Table 2 thereof there shall be substituted the

following
