(CAP. 65)

Taxi Services (Amendment No. 2) Regulations, 2012

IN exercise of the powers conferred by article 43 of the

Authority for Transport in Malta Act and by article 54 of the Traffic

Regulation Ordinance, the Minister for Infrastructure, Transport and

Communications has, after consultation with the Authority for

Transport in Malta, made the following regulations:-

The title of these regulations is the Taxi Services

(Amendment No. 2) Regulations, 2012 and they shall be read and

construed as one with the Taxi Services Regulations, hereinafter

referred to as "the principal regulations".

Regulation 2 of the principal regulations shall be amended

as follows

(a)

the definition " ‘category L5e vehicle’, ‘category

L6e vehicle’ and ‘category L7e vehicle’ " shall be deleted;

(b) in the definition "electric mini cab", immediately

after the words "electrically propelled vehicle", there shall be

added the words "or an electric power assisted pedal cycle";

(c) immediately after the definition "electric mini cab

stand" there shall be inserted the following new definition

" "electric power assisted pedal cycle" means, for

the purposes of these regulations, an electrically propelled

vehicle which is

(a)

fitted with pedals capable of propelling it;

(b) fitted with an electric motor capable of

propelling it;

(c) capable of travelling at a speed of not less

than 15 kilometres per hour and not more than 25

kilometres per hour;

(d) has a maximum width that does not exceed

1.2m;";

(d) in the definition "electrically propelled vehicle",

paragraph (a) shall be deleted, and paragraphs (b) and (c)

thereof shall be renumbered as paragraphs (a) and (b)

respectively.

Regulation 9 of the principal regulations shall be amended Amends

(a) in sub-regulation (1) thereof the words "in terms of

these regulations." shall be substituted by the words "in terms of

these regulations:" and immediately thereafter there shall be

added the following proviso

"Provided that a person may drive an electric

power assisted pedal cycle if he holds either a taxi driver

permit, or an electric power assisted pedal cycle driver

permit in terms of sub-regulation (2) of this regulation";

(b) sub-regulations (2) to (4) thereof shall

be

renumbered as sub-regulations (3) to (5) respectively;

(c) immediately after sub-regulation (1) thereof, there

shall be added the following new sub-regulation

"(2) An electric power assisted pedal cycle driver

permit shall be granted to a person to drive an electric

power assisted pedal cycle, and unless otherwise

specifically provided, the provisions of these regulations

which regulate taxi driver permits shall mutatis mutandis

apply to electric power assisted pedal cycle driver permits,

and accordingly any references which include taxi drivers

in these regulations shall be deemed to include a reference

to drivers of electric power assisted pedal cycles, provided

that sub-regulations (3) and (4) and regulation 12(1) shall

not be applicable to drivers of electric power assisted pedal

cycles.".

Sub-regulation (1) of regulation 11 of the principal Amends

regulation 11 of

regulations shall be amended as follows

the principal

regulations.

(a) in paragraph (b) thereof, the words "(Driving

Licences) Regulations;" shall be substituted by the words

"(Driving Licences) Regulations:" and immediately thereafter

there shall be added the following proviso

"Provided that an electric power assisted pedal

cycle driver permit shall not be issued unless the applicant

is in possession of a driving licence in either categories

AM, A1, A2 or A or category B in terms of the Motor

Vehicles (Driving Licences) Regulations;";

(b) paragraph (d) thereof shall be substituted by the

following

"(d) is aged nineteen years or over, or eighteen

years or over in the case of an applicant for an electric

power assisted pedal cycle driver permit; and".

Regulation 12 of the principal regulations shall be

amended as follows

(a) sub-regulations (2) and (3) thereof shall be

renumbered as sub-regulations (3) and (4) respectively;

(b) immediately after sub-regulation (1) thereof, there

shall be added the following new sub-regulation

"(2) An applicant for an electric power assisted

pedal cycle driver permit shall be considered to have the

requisite skills to act as a driver of an electric power

assisted pedal cycle if he

(a) attends training courses held or approved

by the Authority based on the subjects listed in

paragraphs 2, 3(b), 4 and 5 of Part 1 of the Third

Schedule;

(b) passes a written or an oral examination

held by the Authority or by a body approved by the

Authority, based on the subjects referred to in the

preceding paragraph.".

Regulation 24 of the principal regulations shall be

amended as follows

(a) in sub-regulation (1) thereof, the words " "TAXI M"

followed by three numbers from "001" to "200" ", shall be

substituted by the words " "TAXI" followed by three numbers

from "001" to "200" followed by the letter "M" ";

(b) in sub-regulation (2) thereof, the words " "TAXI G"

followed by three numbers from "001" onwards", shall be

substituted by the words " "TAXI" followed by three numbers

commencing from "001" onwards followed by the letter "G" ";

(c)

in sub-regulation (3) thereof, the words " "TAXI M"

followed by three numbers commencing from "201" onwards",

shall be substituted by the words " "TAXI" followed by three

numbers commencing from "201" onwards followed by the

letter "M" ".

Sub-regulation (1) of regulation 33 of the principal Amends

regulation 33 of

regulations shall be amended as follows

(a) in paragraph (b) thereof, the words "of electric mini

cabs in category L5e" shall be substituted by the words "of

electric power assisted pedal cycles"; and

(b) the words "in terms of these regulations." shall be

substituted by the words "in terms of these regulations:" and

immediately thereafter there shall be added the following

proviso

"Provided that electric power assisted

pedal cycles shall only be registered with the

Authority in terms of the Low-Powered

Vehicles and Pedal Cycles Regulations.".
