Housing Authority (Transfer of Assets) (No. 5) Order, 2012

IN exercise of the powers conferred by article 12 of the

Housing Authority Act, the President of Malta has made the

following order:-

The title of this order is the Housing Authority (Transfer

of Assets) (No. 5) Order, 2012.

The property described in article 4 of this order is hereby

specified for the purpose of article 12 of the Housing Authority

Act.

The property specified in article 2 of this order shall be

transferred and vest in the Housing Authority as provided in the

aforesaid article with effect from the 2nd of October, 2012.

The property referred to in article 2 of this order is the

following, that is to say

(1) A plot of land consisting of Plots 1 to 17 at

Gebel Anxjur Housing Estate in Wied il-Għajn, having an area

of approximately 3, 386 square metres, is bounded on the North-

West by Triq il-Qrempuċ, on the South-West by Government

property and on the South-East by Triq l-Iskal. This plot falls on

Government property acquired by President’s Declaration No. 494,

495 and 507 dated 3rd May, 2012 and is indicated edged in red on

plan P.D. 2012_644 (HAM 59/80).

(2) Two plots of land at tad-Dib Housing Estate in

Mosta as follows:-

(a) a plot of land known as Site A, consisting of Plots

72 to 77, having an area of approximately 1, 397 square

metres. This site is bounded on the East by Triq Vnezja, on

the South by Triq Alofju Wignacourt and on the West by Triq

il-Ballata and is registered with the Government as Tenements

X05519 to X05524 and is shown edged in red and marked

“A” on plan P.D. 2012_700;

(b) a plot of land known as Site B, consisting of Plots

91 to 96, having an area of approximately 1, 410 square metres.

This site is bounded on the West by Triq Vnezja, on the South by

Triq Alofju Wignacourt and on the North by property which is in

the course of acquisition by the Government and registered with

the Government as Tenements X05538 to X05543 and is shown

edged in red and marked “B” on plan P.D. 2012_700.

Both sites were acquired by the Government by President’s

Declaration No. 815 dated 30th July 2012. (HAM 856/88).

(3) A plot of land consisting of Plots 42 to 58 and 76 to

80 at Ta’ Kirċippu Housing Estate in Siġġiewi, having an area

of approximately 5, 311 square metres and is bounded on the

North-East in part by Triq in-Nirien and in part by property

transferred to the Housing Authority, on the South-West by Triq

Karmenu Vassallo and on the South-East by property transferred

to the Housing Authority. These plots are registered as Tenements

X03669 to X03683, X02115 and X02116, and X03684 to

X03688 and fall on Government property acquired by President’s

Declaration No. 611 and 612 dated 6th June 2012, by Deed No.

223 dated 29th November 2005 in the acts of Notary V. Miceli, by

Deed No. 95 dated 1st June 2009 in the acts of Notary D. Charles,

by Cedola No. 140 dated 31st January 2003, and on Government

land formerly part of Tenement No. 50683. The land where these

plots are located is shown edged in red on plan P.D. 52_89_5.

(4) A plot of land, known as Plot 204, at Triq ir-Rand,

in Santa Luċija, having an area of approximately 213.79 square

metres and is bounded on the South-West by Triq ir-Rand, on the

North-East by property transferred to the Housing Authority and

on the North-West by property granted on perpetual emphyteusis.

The plot is subject to a perpetual emphyteusis as per Deed No.

314 dated 9th September, 1976 in the acts of Notary A. Grech.

The plot falls on Government property acquired by Deed No. 545

dated 22nd July, 1974 and by Deed No. 550 dated 13th June, 1975

both in the acts of Notary A. Attard and is registered in the Estate

Management Department records as Tenement No. 41367 and

is shown edged in red and marked “(P. 204 No.8)” on plan L.D.

11/82/78. (HAP 7/2012).

(5) A plot of land known as Plot 135, at Triq is-Sardinell,

forming part of the San Ġwann Government Housing Estate,

Neighbourhood II, in San Ġwann, having an area of approximately

127.47 square metres, bounded on the North by Government

property granted on temporary emphyteusis, on the East by Triq

is-Sardinell and on the West by Government property. The plot is

subject to a perpetual emphyteusis as per Deed No. 40/78 P dated

15th November, 1978 in the acts of Notary F. Pellegrini. The

plot falls on part of Government property formerly registered as

Tenement No. 51328 and is registered in the Estate Management

Department records as Tenement No. 41546 and is shown edged in

red and marked “P. 135” on plan L.D. 128/80/25. (HAP 2/2012).

(6) A plot of land known as Plot 104 in Triq iċ-Ċikas,

Bulebel iż-Żgħir, Żabbar Home Ownership Scheme, in Żabbar. Plot

104 has an area of approximately 119 square metres and is subject

to a temporary emphyteusis by Deed No. 313 dated 10th October,

1970 in the acts of Notary A. Grech. The said Plot is bounded on

the South by property transferred to the Housing Authority, on the

East by Triq iċ-Ċikas, and on the West by open space. Plot 104

formerly formed part of Tenement No. 50785 and is registered

in the Estate Management Department records as Tenement No.

65922 and is shown edged red and marked ‘Plot 104’ on plan L.D.

37/81/39. (HAP 3/2011).
