Public Procurement (Amendment No. 4) Regulations, 2012

BY VIRTUE of the powers conferred by article 4 of the

Financial Administration and Audit Act, the Minister of Finance, the

Economy and Investment has made the following regulations:-

The title of these regulations is the Public Procurement

(Amendment) Regulations, 2012, and these regulations shall be read

and construed as one with the Public Procurement Regulations,

hereinafter referred to as the " principal regulations ".

In regulation 3 of the principal regulations, immediately

after the words "to be included in Schedule 2.", there shall be

added the words "These regulations further provide for the

implementation of Directive 2007/66/EC of the European

Parliament and of the Council of 11th December 2007 amending

Council Directives 89/665/EEC and 92/13/EEC with regard to

improving the effectiveness of review procedures concerning the award

of public contracts.".

The Maltese version of paragraph (d) of regulation 20 of

the principal regulations shall be amended as follows

(a) for the words "sejħa għall-offerti fil-Gazzetta",

there shall be substituted the words "sejħa għal

kwotazzjonijiet fil-Gazzetta";

(b) for the words "Dawk l-offerti kollha għandhom",

there shall be substituted the words "L-offerti u l-

kwotazzjonijiet għandhom"; and

(c) for the words "tal-offerti kollha li jkunu saru",

there shall be substituted the words "tal-offerti u tal-

kwotazzjonijiet li jkunu saru".

In sub-regulation (3) of regulation 21 of the principal

regulations, for the words " from the publication of the notice " there

shall be substituted the words "from the date of notification ".
