Public Procurement (Amendment) (No. 3) Regulations, 2012

BY VIRTUE of the powers conferred by article 4 of the

Financial Administration and Audit Act, the Minister of Finance, the

Economy and Investment has made the following regulations:-

The title of these regulations is the Public Procurement

(Amendment) (No. 3) Regulations, 2012, and these regulations shall

be read and construed as one with the Public Procurement

Regulations, hereinafter referred to as the "principal regulations".

Paragraph (c) of sub-regulation (1) of regulation 17 of the

principal regulations shall be substituted by the following

"(c) public contracts, which are declared to be secret,

when their performance must be accompanied by special

security measures in accordance with the laws, regulations or

administrative provisions in force in the EU Member State

concerned, or when the protection of the essential interests of

the Member State so require;".
