NOTARIAL PROFESSION AND NOTARIAL ARCHIVES

(AMENDMENT) ACT, 2011

Commencement Notice

IN exercise of the powers conferred by article 1(2) and (3) of the

Notarial Profession and Notarial Archives (Amendment) Act, 2011,

hereinafter referred to as "the Act", the Minister of Finance, the

Economy and Investment has established the 1st January, 2012, as the

date when the provisions of the following articles of the Act shall

come into force, without prejudice to any of the applicable provisions

of article 103 of the Act: articles 1, 2, 3(a), 3(b) (but only where

article 2(3) is added to the Notarial Profession and Notarial Archives

Act, hereinafter referred to as "the principal Act"), 4, 6, 7 (but only

where it adds article 6(1)(a) to the principal Act; and for such time as

article 7 of the Act shall not have come into force in its entirety,

article 6(1)(a) of the principal Act added by the Act shall be

numbered as article 6(a)), 12 (but only where it adds article 10B to

the principal Act), 13, 16 (which shall refer to notarial acts whenever

published, and to the registers of such acts), 17, 18, 23(j), 27, 28, 29,

35, 36, 37, 38(a), 39, 40, 41, 42, 43, 44, 45, 46, 47, 48(a) (which shall

refer to notarial acts whenever published), 48(b), 48(c), 48(d), 48(e),

49 (which shall refer to notarial acts whenever published), 50, 51

(which shall refer to the registers of notarial acts whenever

published), 52, 53, 55(a)(ii), 55(b), 58, 59, 60(a), 60(b), 60(d), 60(e),

60(f), 62, 63, 64, 65(a), 65(b), 66, 68, 69, 70, 71 (notwithstanding that

there is a reference therein to article 94A of the principal Act, which

article 94A added by the Act shall come into force on a later date), 73,

74, 75, 76, 77, 91, 92, 93, 94, 95, 96, 97, 98 (notwithstanding that

there is a reference therein to articles 94A and 94B of the principal

Act added by the Act, which articles come into force on a later date),

99(a), 99(h), 101, and 103.

The provisions of articles 91, 93, 94, 95 and 96 of the Act shall

be without prejudice to the provisions of articles 98 and 103 of the

Act.

Where articles 93 and 96 of the Act refer to provisions of the

principal Act which were amended by the Act, and such provisions as

amended have not yet come into force, articles 93 and 96 of the Act

shall start affecting such provisions as soon as the amendments to

such provisions come into force and, for such time as such provisions

shall not yet have come into force, the provisions of the principal Act

as they stood before the coming into force of such amendments made

by means of articles 93 and 96 shall continue to apply.
