Assessment and Management of Flood Risks (Amendment)

Regulations, 2011

IN exercise of the powers conferred by article 28 of the Malta

Resources Authority Act, the Minister for Resources and Rural

Affairs, in consultation with the Malta Resources Authority, has made

the following regulations:-

The title of these regulations is the Assessment and

Management of Flood Risks (Amendment) Regulations, 2011, and

these regulations shall be read and construed as one with the

Assessment and Management of Flood Risks Regulations, hereinafter

referred to as "the principal regulations".

In sub-regulation (5) of regulation 5 of the principal

regulations, for the words "with a low probability or extreme event

scenarios." there shall be substituted the words "with a low

probability or extreme event scenarios:", and immediately thereafter

there shall be added the following new proviso

"Provided that for coastal areas the Authority shall

establish criteria for determining whether an adequate level of

protection is in place.".

In sub-regulation (3) of regulation 6 of the principal

regulations, immediately after the words "The Flood Risk

Management Plan shall include" there shall be added the words

"measures for achieving the objectives established in accordance with

sub-regulation (2) as well as".

In paragraph (a) of sub-regulation (1) of regulation 7 of the

principal regulations, immediately after the words "with relevant

information pertaining to the Water Policy Framework Regulations"

there shall be added the words "and shall be coordinated with, and

may be integrated into, the reviews provided for in regulation 5(2) of

the said Water Policy Framework Regulations".
