General Authorisations (Radiocommunications Apparatus)

(Amendment) (No.2) Regulations, 2011

IN exercise of the powers conferred upon him by article 34

of the Electronic Communications (Regulation) Act, the Minister

for Infrastructure, Transport and Communications, has made the

following regulations:-

Authorisations (Radiocommunications Apparatus) (Amendment)

(No.2) Regulations, 2011, and they shall be read and construed

as one with the General Authorisations (Radiocommunications

Apparatus) Regulations, 2008, hereinafter referred to as “the

principal regulations”.

jinqraw u jiftiehmu ħaġa waħda mar-Regolamenti tal-2008 dwar

Awtorizzazzjonijiet Ġenerali (Apparat tar-Radjokomunikazzjoni),

hawn iżjed ’il quddiem imsejħa “ir-regolamenti prinċipali”.

The Third Schedule to the principal regulations shall be

amended as follows

(a) in paragraph 2 thereof, immediately after the

definition “automotive short-range radar apparatus put into

service in the Community” there shall be added the following

new definition

“ “Directive 2007/46/EC” means Directive

2007/46/EC of the European Parliament and of the

Council of 5 September 2007 establishing a framework

for the approval of motor vehicles and their trailers, and

of systems, components and separate technical units

intended for such vehicles (Framework Directive);”;

(b) in paragraph 2 thereof, immediately after the

new definition “Directive 2007/46/EC” there shall be added

the following new definition

“ “reference dates” means 30 June 2013 for the

frequency between 21.65 and 24.25 GHz and 1 January

2018 for the frequency between 24.25 and 25.65 GHz.”;

(c) in the English text of paragraph 3(2) thereof, for

the words “peak power density of 0 dBm# 50MHz e.i.r.p.,”

there shall be substituted with the words “peak power density

of 0 dBm/50MHz e.i.r.p.,”;

(d) in paragraph 3(6) thereof, for the words “shall

not exceed -9 dBm#5MHz e.i.r.p.” there shall be substituted

the words “shall not exceed -9 dBm/5MHz e.i.r.p.”;

(e) in paragraph 4(1) thereof, for the words “until

30 June 2013” there shall be substituted the words “until the

reference dates”;

(f) in paragraph 4(2) thereof, for the words “After

30 June 2013,” there shall be substituted the words “After

the reference dates” and for the words “before that date in

the Community” there shall be substituted the words “before

those dates in the Community”;

(g) paragraph 4(3) thereof shall be renumbered as

paragraph 4(4) and immediately after paragraph 4(2) thereof

there shall be added the following new paragraph

“(3) The date 1 January 2018 shall be extended

by four years for automotive short-range radar apparatus

mounted on motor vehicles for which a type-approval

application has been submitted pursuant to Article 6(6)

of Directive 2007/46/EC and has been granted before 1

January 2018.”.
