Maintenance of Good Order at Places of Entertainment

(Amendment) Regulations, 2011

IN exercise of the powers conferred by articles 183(2) and 203

of the Code of Police Laws, the Minister for Justice and Home Affairs

has made the following regulations:-

The title of these regulations is the Maintenance of Good Citation.

Order at Places of Entertainment (Amendment) Regulations, 2011

and these regulations shall be read and construed as one with the S.L. 10.40.

Maintenance of Good Order at Places of Entertainment Regulations,

hereinafter referred to as the "principal regulations".

Regulation 2 of the principal regulations shall be amended Amends

regulation 2 of

as follows

(a) immediately after the definition "Commissioner’ there

shall be inserted the following definition

" "concert venue" means a place where a musical

performance by one or more performing artists present at the

venue is held for an audience;";

(b) immediately after the definition of "inhabited area" there

shall be inserted the following new definition

" "performing artist" does not include a disc jockey or an

actor performing a part in a play other than a musical;";

(c) in the definition of "place of entertainment" the words

"excluding such theatre when staged dancing is watched by a seated

audience" there shall be substituted the words "excluding places

where seats are provided for stage performances or plays to be

watched by a completely seated audience" and immediately after the

words "show or dancing is carried out;" there shall be added the

words "but does not include a concert venue;"; and

(d) in the definition of "proprietor" immediately after the

words "of such juridical person." there shall be added the words

"Proprietor" shall not include the Commissioner of land in relation to

places of entertainment or concert venues which consist of streets or

other public property.".

In regulation 4 of the principal regulations the words "the

premises," shall be substituted with the words "a place of

entertainment or a concert venue,".

In regulation 5 of the principal regulations for the words

"any place of entertainment." there shall be substituted the words

"any place of entertainment or concert venue.".

In regulation 6 of the principal regulations, immediately

after subregulation (5) there shall be added the following

"(6) Persons under the age of seventeen may be allowed

inside a concert venue. Provided that

(a) where alcoholic beverages are sold or made

available at a concert venue to which persons under the age

of seventeen are admitted, such alcoholic beverages shall

only be sold or served in a physically separate area of the

concert venue as indicated or approved by the

Commissioner to which access shall be limited to persons

over seventeen years of age; and

(b) the Commissioner may if he considers it

necessary

(i)

order the proprietor to observe any

conditions and to make any arrangements as the

Commissioner may notify to the proprietor for the

purpose of preventing the happening of any violation

of the law relating to the maintenance of public order

at the concert venue or relating to the sale of

alcoholic beverages or tobacco products to persons

who are not legally entitled to purchase such

products at or in the vicinity of the said venue;

(ii) require the proprietor to provide a bank

guarantee to the satisfaction of the Commissioner and

in an amount not exceeding fifty thousand euro

(50,000) for the purpose of guaranteeing that no

alcoholic beverages will be sold to or consumed by

persons under the age of seventeen at the concert

venue and for the purpose of guaranteeing the

observance of all the obligations and conditions

relating to the order referred in subparagraph (i).".

In regulation 7 of the principal regulations, in

subregulation (1) thereof, immediately after the words "or is leaving a

place of entertainment" there shall be added the words "or a concert

venue".

In regulation 10 of the principal regulations for the words Amends

In regulation 13 of the principal regulations the words Amends

Regulation 14 of the principal regulations shall be

amended as follows

(a) in subregulation (1) thereof the words "not less than fifty

eight euro and twenty-three cents (58.23) but not exceeding one

hundred and sixteen euro and forty-seven cents (116.47)" shall be

substituted with the words "not less than sixty euro (60) but not

exceeding one hundred and twenty euro (120)" and for the words "or

subsequent conviction to a fine (multa) of not less than one hundred

and sixteen euro and forty-seven cents (116.47) but not exceeding two

hundred and thirty two euro and ninety-four cents (232.94)" there

shall be substituted the words "or subsequent conviction to a fine

(multa) of not less than one hundred and twenty euro (120) but not

exceeding two hundred and fifty euro(250)"; and

(b) in subregulation (2) thereof immediately after the words

"from attending any place of entertainment" there shall be added the

words "or concert venue".

In subregulation (1) of regulation 15 of the principal

regulations for the words "four hundred and sixty-five euro and

eighty seven cents (465.87) but not exceeding nine hundred and thirty

one euro and seventy-five cents (931.75)" there shall be substituted

the words "five hundred euro (500) but not exceeding one thousand

euro (1000)" and for the words "not less than one thousand one

hundred and sixty-four euro and sixty-nine cents (1,164.69) but not

exceeding two thousand and three hundred and twenty-nine euro and

thirty-seven cents" there shall be substituted the words "not less than

one thousand two hundred euro (1200) but not exceeding two

thousand and five hundred euro (2500)".

Regulation 17 of the principal regulations shall be

amended as follows

(a) in subregulation (2) thereof immediately after the words

"the right to inspect any place of entertainment" there shall be added

the words "or concert venue";

(b) in subregulation (3) thereof immediately after the words

"to be used as a place of entertainment" there shall be added the

words "or as a concert venue"; and

(c) in subregulation (6) thereof immediately after the words

"or licence for any place of entertainment" there shall be added the

words "or concert venue".
